RES NO 03-03-1985 3- 3-1985 CITY OF VAN BUREN, ARKANSAS RESOLUTION NO. 3 -1985 A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE A 60 FOOT EASEMENT OVER THE EAST 60 FEET OF LOTS 1 THRU 6, BLOCK 6, VISTA PLACE ADDITION TO THE CITY OF VAN BUREN, CONTAINING 0.21 ACRES, MORE OR LESS, TO THE CITY OF FORT SMITH FOR CONSTRUCTION OF NEW WATER LINE. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS: THAT, the City Council authorizes and directs the Mayor to execute the following easement to the City of Fort Smith and the City Clerk is authorized and directed to attest same. The East 60 Feet of Lots 1 Thru 6, Block 6, Vista Place Addition to the City of Van Buren, containing 0.21 acres, more or less, to the City of Fort Smith for construction of new Water Line. THAT, a copy of said easement is attached hereto and made a part hereof. PASSED AND APPROVED THIS 18th DAY OF March 19 85 MAYOR '-ATTESTED: r Jam_., CI'Y CLERK -TREAS RER K 3 3� y5 EASEMENT TRACT: WTL -35 KNOW ALL MEN BY THESE PRESENTS: That The City of Van Buren, Arkansas GRANTOR(S), for and in consideration of the sum of ONE DOLLAR ($1.00) and other good and valuable considerations, receipt of which is hereby acknowledged, do hereby grant, bargain, sell and convey to the CITY OF FORT SMITH, ARKANSAS, GRANTEE, its successors and assigns, a permanent easement and right -of- way for the construction and maintenance of one or more 48 INCH, or other dimension, WATERLINE(S) with all appurtenances thereto, together with the right to remove trees, brushes, undergrowth or other obstructions interferring with operation and maintenance of said WATERLINE(S) over, under and upon the following lands situated in the County of CRAWFORD, State of Arkansas, to -wit: A strip of land 60 feet in width in the North- east Quarter of the Southwest Quarter of Section 24, Township 9 North, Range 32 West of the Fifth Principal Meridian in Crawford County, Arkansas, more particularly described as follows, to -wit: The East 60 feet of Lots 1, 2, 3, 4, 5 and 6, Block 6, Vista Place Addition to the City of Van Buren, Arkansas, containing 0.21 acres, more or less with rights of ingress and egress to and from the same. To have and to hold the same to the said GRANTEE, its suc- cessors and assigns forever. The said GRANTOR(S), heirs and assigns, to fully use and enjoy said premises, provided, that they shall not interfere with the use thereof by GRANTEE and further GRANTOR(S), heirs and assigns, will not erect a permanent building or other structure within the width of said ease- ment. Grantee agrees to bury all pipelines of sufficient depth so as to not interfere with cultivation of soil. The consideration paid by the GRANTEE is received and ac- cepted by the GRANTOR(S) in full satisfaction of every right hereby conveyed. It is hereby understood that party securing this grant in behalf of Grantee is without authority to make any covenant or agreement not herein expressed. Bell and Ann Graham to me personally well known, who stated that they were the Mayor and City Clerk /Treasurer of Van Buren, Arkansas a corporation, and were duly authorized in their respective capacities to execute the foregoing instrument for and in the name and behalf of said corporation, and further stated and acknow- ledged that they had so signed, executed and delivered said foregoing instrument for the consideration, uses and purposes therein mentioned and set forth.
