ORD NO 21-2007 CITY OF VAN BUREN, ARKANSAS ORDINANCE NO. zi2 -2007 BE If ENACTED BY THE CITY COUNCIL, FOR THE CITY OF VAN BUREN, ARKANSAS AN ORDINANCE TO BE ENTITLED: AN ORDINANCE AUTHORIZING THE MAYOR TO CONTRACT FOR, AND TO PURCHASE, CERTAIN VEHICLES FOR THE VAN BUREN POLICE DEPARTMENT THROUGH THE STATE PURCHASE CONTRACT; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES. WHEREAS, the City of Van Buren is in immediate need of certain additional police vehicles for the safety of life and protection of property by the City of Van Buren Police Department; and WHEREAS, the City of Van Buren desires to purchase four police vehicle units, equipped as setforth in attachment "A" hereto, more specifically: (3) Ford Crown Victoria, Four Door Large Police Pursuit Sedans (1) Ford F150. Full Size One -Half Ton Pickup Truck; and WHEREAS, the City is authorized to waive the expense and time of bidding, by purchasing vehicles though the state purchase contract, pursuant to ARK. CODE ANN. 19 -11- 249; and WHEREAS, the City has decided that it is in its best interest to purchase the above listed vehicles via the 2007 Arkansas State Contract Award No. SP -07 -0035, at an estimated amount of $75,963.00: and WHEREAS, there are Federal Forfeiture funds available for the purchase one of the Crown Victorias; and WHEREAS, the purchase of these vehicles and the expedited receipt of same by use of the state purchasing contract is necessary for the immediate health, safety and welfare of the citizens of Van Buren, an emergency is hereby declared to exist; NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY TFIE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS, THAT: SECTION 1: The Police Department of the City of Van Buren, Arkansas is in immediate need of SECTION 2: Said vehicles are to be purchased via the 2007 Arkansas State Contract Award No. SP -07 -0035, from Lander's Ford and Cavenaugh Fleet, respectively, for a combined total sum of $75,963.00. as setforth in attachment "A" hereto. SECTION 3: It is further found that due to immediate need to acquire these vehicles an emergency is declared to exist and this ordinance being necessary for the preservation of the public health, safety, and welfare, it shall take effect from and after its passage and approval. SECTION 4: The Mayor is further authorized to enter into an agreement with an appropriate financial institution in order to finance payment of these vehicles, pursuant to Amendment 78, Section 2 of the Constitution of the State of Arkansas, if necessary. SECTION 5: The Mayor and City Clerk are hereby authorized by the City Council for the City of Van Buren to execute all documents, contracts, and agreements necessary to effectuate this Ordinance. SECTION 6: The various provisions and parts of this Ordinance are hereby declared to be severable, and, if any section or part of a section, or any provision or part of a provision herein, is declared to be unconstitutional, inappropriate, or invalid by any court of competent jurisdiction, such holding shall not invalidate or affect the remainder of this Ordinance and to that extent the provisions hereto are declared to be severable.
