ORDINANCE NO. 3 -2007
BE IT ENACTED BY THE CITY COUNCIL, FOR THE CITY OF VAN BUREN,
ARKANSAS, AN ORDINANCE TO BE ENTITLED.
AN ORDINANCE TO AMEND ORDINANCE NO. 7 -1963 (VAN
BUREN MUNICIPAL CODE NO. 14.04.01) FOR THE PURPOSE
OF REZONING CERTAIN PROPERTY IN THE CITY OF
VAN BUREN, ARKANSAS, AMENDING THE ZONING MAP OF
THE CITY OF VAN BUREN. ARKANSAS. DECLARING AN
EMERGENCY AND FOR OTHER PURPOSES.
WHEREAS, The Planning Commission has recommended that certain property within the city
limits of the City of Van Buren be rezoned from its previous classification to the
following:

Lots 1 thru 4, less and except R -1 R -2
the west 100 feet, Block 10,
Vista Place, more commonly
known as 203 Prospect Ave.•
Van Buren, Arkansas
WHEREAS, Notice of a Public Hearing was duly published and a Public hearing was conducted
as required by law (A.C.A. 14 -56 -422); and
WHEREAS, The proposed rezoning herein was reconunended by a majority vote of the entire
Planning Commission, in accordance with A.C.A. 14 -56 -422; and
WHEREAS, Time is of the essence and an emergency has been determined to exist;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
VAN BUREN, ARKANSAS:
SECTION 1: The above- described property is hereby rezoned and the Van Buren Zoning Map is
hereby amended to reflect this rezoning; and
SECTION 2: The adopted rezoning shall be filed in the office of the City Clerk, in accordance with
A.C.A. 14- 56- 422(5); and
SECTION 3: An emergency is hereby declared to exist and this Ordinance shall take full force and
effect upon its passage by a vote of 2 /3rds or more of the City Council.
IN WITNESS WHEREOF. the City of Van Buren, Arkansas. by its City Council, did pass,
approve, and adopt, by a vote of p for and 0 against, the foregoing Ordinance at its meeting
held on the 26th day of March, 2007.

above referenced property was approved. Attached you will find fifteen (15) copies of the
rezoning request.
We request that this be considered at the meeting on March +9, 2007 and that if the rezoning is

Dear Mayor and others:
At the request of Mr. Thomas L. Craft, Jr. speaking for Thomas L. Craft, Jr. Inter Vivos Trust, we
are petitioning a rezoning request.
The property is at 203 Prospect Avenue, Van Buren, Arkansas. It is currently zoned R -1.
We are requesting a change to zoning district R-2 to allow the construction of duplexes.
The property is platted as Lots 1 -4. Less and except the west 100 feet, Block 10, Vista Place,
and addressed as 203 Prospect Avenue.
This property is currently vacant. The old one -story single family residence has been removed.
This property was considered for rezoning at the August 2, 2005 Planning Commission Meeting.
At that time, R- 3 zoning was request. This request was denied but it was noted that the
Planning Commission would support an R -2 zoning.
The denial was taken to the Van Buren City Council to appeal the Planning Commission action
to deny the rezoning request. This was presented to the August 15, 2005 City Council meeting.
At this meeting, the City Council voted to uphold the Planning Commission denial for R -3. The
City Council indicated that they would support R -2 but that it would have to go back to the
Planning Commission.
Based on the above, we are submitting this request to the Planning Commission, Mayor and
