ORD NO 01-2007 CITY OF VAN BUREN, ARKANSAS ORDINANCE NO. 1 2007 BE IT ENACTED BY THE CITY COUNCIL, FOR THE CITY OF VAN BUREN, ARKANSAS, AN ORDINANCE TO BE ENTITLED: AN ORDINANCE AUTHORIZING THE MAYOR TO PURCHASE SOFWARE FOR THE POLICE DEPARTMENT, WAIVING BIDDING REQUIREMENTS, DECLARING AN EMERGENCY, AND FOR OTHER PURPOSES. WHEREAS, The Police Department has been using Information Technologies, Inc. Records Management software to draft and store police reports since 1998; and WHEREAS, In 2004 the Council approved upgrading the software from the Standard Edition to the Enterprise Edition, but due to errors in the software that needed to be repaired and other issues with the software, the City did not purchase the upgrade at that time; and WHEREAS, Since 2004, the problems with the software have been resolved and the Police Department desires to purchase the software to upgrade their system, which is becoming out -of -date; and WHEREAS, Section 14 -58 -303 of the Arkansas Code Annotated provides that "The governing body, by Ordinance, may waive the requirements of competitive bidding in exceptional situations where such procedure is deemed not feasible or practical and WHEREAS, It is impractical to consider other companies to provide the software because upgrading with the current company will ensure the transference and retention of records prior to the update. NOW, THEREFORE, BE IT ORDANIED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS: SECTION 1: THAT the City Council waives the requirements of competitive bidding in this particular case as such procedure is not deemed feasible or practical. SECTION 2: THAT the Mayor is authorized to purchase the Enterprise Edition of Records Management for a price not to exceed 521,625.00. SECTION 3: THAT the upgrade and purchase of the software is necessary to secure the bid price, which is only valid through January 31, 2007, and to ensure 0 that police department records are maintained in an efficient, secure and up -to -date manner, and, therefore, for the immediate preservation of the public peace, health and safety, an emergency is declared and this Ordinance shall take effect and be in full force after is passage and approval. �J 'PASSED AND APPROVED THTS Ot` I t DAY OF JANUARY, 2007. 1 Robert D.
