AN ORDINANCE ESTABLISHING A UTILITY
ASSISTANCE PROGRAM
BE IT ORDAINED AND ENACTED BY TIIE CITY COUNCIL OF THE CITY
OF VAN BUREN, ARKANSAS, THAT:
SECTION 1: There is hereby established a Sewer Utility
Assistance Program, hereinafter referred to as "the program
SECTION 2: The program is available to those utility customers
who are natural persons and who use sewer utility services for
residential purposes solely.
SECTION 3: The following eligibility requirements must be met,
in addition to the requirements in Section 2 above, in order to
participate in the program:
A. The applicant's gross household income must not exceed
$10,000 per calendar year.
B. The applicant's city utility bill must be in his /her legal
name.
SECTION 4: Renters, whose utilities are included in the monthly
rental charge, are ineligible. Renters, residing in subsidized
housing, who do not pay a city utility bill, are ineligible. Renters
who do pay a city utility bill are eligible.
SECTION 5: Customers wishing. to apply for assistance from the
program must apply between November 1 and November 15, 1988, in order
to receive assistance from December 1, 1988. Customers who qualify
after November 15, 1988 will receive assistance beginning with the
first billing cycle thereafter. Customers who have been approved
to participate in the program who move from one address to another
Ail must apply for continued participation in the program prior to moving
to the new address. Each application for continued participation
shall meet all requirements established in Sections 2, 3, and 4.

-11 customers wishing to receive continuing assistance must be re-
qualified on a yearly basis, as directed by the Water and Sewer
Department.
SECTION 6: Application for participation in this program shall
be made to the Van Buren Senior Citizens Center, at locations to be
approved in advance by the Water Superintendent. The Senior Inn is
authorized to make a determination of eligibility of applicants, and
may use such available sources such as governmental agencies to
verify the information contained in the application form. The forms
for application shall be approved in advance by the Water and Sewer
Department. The Water and Sewer Department Superintendent or his
designated agent shall confirm or reject all such determinations of
eligibility for the program.
SECTION 7: Any person whose eligibility for the program is
denied shall be notified in writing. Such customers shall have a
period of ten (10) days to request in writing a hearing before the
Superintendent or his designated agent. At such hearing the
customer shall be entitled to present any desired information re-
garding the eligibility question.
SECTION 8: The Mayor is authorized to execute an agreement
between the City of Van Buren and The Van Buren Senior Citizens
Association, which agreement authorizes the Senior Inn to make an
initial determination of eligibility for the program.
SECTION 9: The rates for residential sewer service for
customers participating in the program shall be fifty percent (50
of the residential sewer rates which would otherwise be paid by
such customer.
