ORD NO 01-1988 CITY OF VAN BUREN, ARKANSAS ORDINANCE NO. -1988 AN ORDINANCE TO AMEND ORDINANCE NO. 7 -1963 FOR THE PURPOSE OF REZONING CERTAIN PROPERTY 0 IN THE CITY OF VAN BUREN, ARKANSAS, AND AMENDING THE ZONING MAP OF THE CITY OF VAN BUREN, ARKANSAS. WHEREAS, Hawkins -Weir Engineers, Inc., authorized agent for First National Bank, Fort Smith, has submitted a Petition to rezone: Lots 115 through 127, 129 through 136, and 174 through 189 of Rickey Addition, Phase III, as filed August 2, 1983, containing 6.9 acres, more or less, in Van Buren, Crawford County, Arkansas, subject lots being located on Flat Rock Drive, James Street, Hollis Drive, and South 36th Street from R -4 to R -3; and WHEREAS, Notice of Hearing has been published in the newspaper and posted on the property as required by law; and WHEREAS, The Hearing has been held as required by law; and WHEREAS, The Planning Commission recommended said Zone Change: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS: Lots 115 through 127, 129 through 136, and 174 through 189 of Rickey Addition, Phase III, as filed August 2, 1983, containing 6.9 acres, more or less, in Van Buren, Crawford County, Arkansas, subject lots being located on Flat Rock Drive, James Street, Hollis Drive, and South 36th Street is rezoned from R -4 to R -3, subject to the following conditions: 1. That the Owner /Developer furnish each Utility and the City with a Letter of Intent, along with any Letters of Credit or Bonds which might be required, stating that any and all financial expenses resulting from the relocation of any utility distribution or service lines will be the total re- sponsibility of the Owner /Developer and that said Letter of Intent will be furnished before any work is commenced. 2.
