RES NO 03-08-1990 3 -g /coo CITY OF VAN BUREN, ARKANSAS RESOLUTION NO. q- .3 -1990 A RESOLUTION TO ENFORCE CLEAN -UP ORDINANCE AGAINST RAILROAD RIGHT -OF- WAYS. WHEREAS, The City of Van Buren has passed and approved an Ordinance regulating the maintenance of real property within the City and requiring the elimination of unsightly, unsanitary or dangerous conditions existing upon real property located within the City; and, WHEREAS, Under the City's "Clean -up" Ordinance, a property owner is required to eliminate overgrown conditions on their property by the cutting, mowing and removal of weeds, grass and brush from their property; and, WHEREAS, Railroad right -of -ways are considered to be real property within the City which are owned by the various railroad companies operating within the City of Van Buren, and as such are the responsibility of the owners to maintain and are subject to the City's "Clean -up" Ordinance; and, WHEREAS, There have been numberous complaints from citizens to City Officials and employees regarding the unkept and overgrown condition of railroad right -of -ways throughout the City City of Van Buren. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS: SECTION 1: That the City of Van Buren expects the owners of all railroad right -of -ways throughout -the City to properly maintain their real property by keeping said right -of -ways sufficiently mowed, cut and cleared of overgrown weeds, grass, brush and to otherwise keep said right of -ways free from unsightly, unsanitary'or dangerous conditions. 0 SECTION 2: That in order to ensure compliance with the City's "Clean -up" Ordinance, the City of Van Buren intends to enforce said Ordinance, including its penalty provisions, against any railroad company found to be in non- compliance due to its failure to properly maintain its right -of -ways.
