ORD NO 16-1990 ORDINANCE NO.
AN ORDINANCE APPROPRIATING UP TO $40,000 FOR THE PURCHASE
OF ONE -HALF A COMPUTER SYSTEM INCLUDING SOFTWARE AND
HARDWARE FOR THE MUNICIPAL COURT OF VAN BUREN, ARKANSAS,
DECLARING AN EMERGENCY AND FOR ANY AND ALL OTHER PURPOSES.
WHEREAS, the Municipal Court is handling approximately
15,000 cases a year and is handling approximately $750,000 per
year; and,
WHEREAS, the caseload for the Municipal Court has increased
dramatically and is placing a severe burden upon the Municipal
Court as far as recording cases is concerned; and,
WHEREAS, the Quorum Court of Crawford County, Arkansas, has
expressed a willingness to pay for one -half the costs of a
computer system for the City of Van Buren, Arkansas; and,
WHEREAS, the costs of a computer system has been estimated
to be up to $80,000.
IT IS, THEREFORE, ORDAINED BY THE CITY COUNCIL OF THE CITY
OF VAN BUREN, ARKANSAS:
THAT the sum of $40,000 be appropriated for the purchase of
one -half of a computer system, including software and hardware,
for the Municipal Court and that the Mayor and City Clerk are
hereby authorized to pay up to $40,000 for one -half the cost of
the system.
THAT based upon the limited number of software programs
available for use in the Municipal Court system the use of
competitive bidding in the purchase of said system is not
practical and, therefore, competitive bidding is hereby waived.
EMERGENCY CLAUSE:
Being that the efficiency of the Municipal Court accounting
recordation and filing is essential to the public welfare and the
public well -being and that the inability of the Municipal Court
to adequately carry out its function would be a great detriment
to the City of Van Buren, Arkansas. It is ascertained and
declared that there is an immediate need in order to purchase
said computer system for the Municipal Court of Van Buren,
Arkansas, in order to protect public health and safety of the
inhabitants of the City of Van Buren, Arkansas, therefore, an
emergency is found to exist and that this Ordinance is necessary
for the preservation of the public peace, health, and safety and
same shall take effect and be in force without delay.
