ORDINANCE NO. 9 1992
AN ORDINANCE ESTABLISHING MONTHLY RATES FOR MANDATORY
RESIDENTIAL SOLID WASTE COLLECTION SERVICE FOR THE CITY
OF VAN BUREN, ARKANSAS; AND FOR OTHER PURPOSES.
WHEREAS, The City of Van Buren has implemented a
mandatory residential solid waste management system and
recycling program pursuant to Ordinance No. 25 -1992; and,
WHEREAS, it is the duty of the City Council of the City
of Van Buren to approve rates, charges or contractual fees
to be charged by residential solid waste disposal firms; and,
WHEREAS, the Van Buren Water and Sewer Commission acting
as agent for the City has recommended a schedule of fees and
charges for implementation of the solid waste management
program.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF VAN BUREN, ARKANSAS:
SECTION 1: The monthly rate to be charged for each
single family residential unit as defined in Ordinance No.
25 -1992 shall be ($7.25) seven dollars and twenty -five cents.
The effective date of these charges shall be January 1, 1993.
These charges shall cover at a minimum once a week pickup
service (excluding curb side recycling and removal of yard
waste materials).
SECTION 2: The billing and collection for single family
residential solid waste collection shall be performed by the
Water and Sewer Department according to its customary billing

and collection procedures and in accordance with agreement
between the contractors and the Water and Sewer Commission.
SECTION 3: The Water and Sewer Commission shall deduct
the sum of ($1.00) one dollar for each customer for whom
a collection was made. The remainder of charges collected
shall be remitted to the collection contractors, in
accordance with the agreement between the Commission and
contractors.
SECTION 4: The Water and Sewer Commission is hereby
authorized to establish a public assistance program for low
income families whose annual income from all sources does not
exceed $10,000.00. The rate to be charged this class of
customers shall be (1/2) one half the total residential rate
as defined in Section 1 of this ordinance.
SECTION 5: That if any Section or part of this
Ordinance shall be held invalid or unconstitutional it shall
not effect the remaining Sections thereof: and the Sections
and parts of said Ordinance shall be treated severally.
SECTION 6: That due to the need to implement and
enforce a comprehensive city wide solid waste management
system and recycling program, this Ordinance being necessary
for the preservation of public peace, health, and safety
shall be in full force and effect from January 1, 1993.
