SPECIAL CITY COUNCIL MEETING
HELD AUGUST 25, 2011
A special called meeting of the City Council of the City of Van Buren, Arkansas met at
5:30 p.m., on Thursday, August 25, 2011 at City Hall. The meeting was called to order by
Mayor Freeman. Council members present were Alderman Swaim, Parker, Ragsdale and Dodd. City
Clerk- Treasurer Barbie Curtis and City Attorney Candice Settle were also present. Alderman Moore and
Sagely were absent. This made a total of seven (7) present. A quorum was declared.
The Mayor ordered spread upon the minutes, the "NOTICE OF SPECIAL MEETING
AND WAIVER OF REGULAR NOTICE OF AND CONSENT TO SPECIAL MEETING."
On the agenda next was to consider A RESOLUTION AUTHORIZING THE FILING
OF AN ACTION FOR PROPERTY EASEMENTS FOR THE RENA ROAD WIDENING
PROJECT. The City Clerk read the Resolution in its entirety. Mayor Freeman asked if there
was any discussion. Mayor Freeman clarified that there will be no houses condemned, only land.
Attorney Phil Bagby will be filing suit and City Attorney Candice Settle elaborated on that filing.
Alderman Swaim seconded by Alderman Dodd moved that the Resolution be adopted. On the
Clerk's calling the roll, the following vote resulted: Ayes Alderman Swaim, Parker, Ragsdale
and Dodd. Nays none.
The Mayor thereupon declared the Resolution adopted and signed the Resolution, which
was attested by the City Clerk and impressed with the seal of the City.

RESOLUTION NO. 8 -5- 2011
BE IT ENACTED BY THE CITY COUNCIL, FOR THE CITY OF VAN BUREN,
ARKANSAS, A RESOLUTION TO BE ENTITLED:
A RESOLUTION AUTHORIZING THE FILING OF AN
ACTION FOR PROPERTY EASEMENTS FOR THE RENA
ROAD WIDENING PROJECT.
WHEREAS, 'Ile City of Van Buren is required to provide the necessary right of way for the
widening of Rena Road; and
WHEREAS, Certain easements are needed across six (6) tracts of property as shown in
Exhibits "A -F" attached hereto; and
WHEREAS, The acquisition of said right of way is a permitted municipal
purpose for which condemnation proceeding many be initiated for the public's
interest; and
WHEREAS, hnmediate passage of this Resolution is required because the Arkansas Highway
Department will withdraw funding for the Rena Road Project if final Right -of-
Way is not certified by September 2, 2011 by the City of Van Buren, Arkansas.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF VAN
BUREN, ARKANSAS, THAT:
Section 1: The Mayor or his designated representative is authorized and directed to file the
necessary condemnation action and take any other steps necessary to acquire the
easements for the Rena Road Widening Project.

There being no further business, motion was made by Alderman Parker seconded by
Alderman Ragsdale to adjourn. The Council followed with a unanimous vote. The meeting
adjourned at 5:45 p.m.
