ORD NO 17-1992 CITY OF VAN BUREN, ARKANSAS ORDINANCE NO. 0 -1992 AN ORDINANCE OF THE CITY OF VAN BUREN, ARKANSAS, PLACING THE VAN BUREN, ARKANSAS, POLICE DEPARTMENT UNDER THE CIVIL SERVICE COMMISSION PURSUANT TO ARK. CODE ANNO. 14 -51 -101 ET SEQ, REFERRING THIS ORDINANCE TO THE VOTE OF THE CITIZENS OF VAN BUREN, ARKANSAS, AND FOR OTHER PURPOSES. WHEREAS, The City of Van Buren, Arkansas is a First Class City of the State of Arkansas, and WHEREAS, The Van Buren, Arkansas, Fire Department is set up under a Civil Service System, pursuant to Ark. Code Anno. 14 -51 -101 et seq, but the Van Buren, Arkansas Police Department is not, and WHEREAS, The citizens of the City of Van Buren, Arkansas, should have an opportunity to vote as to whether or not the Van Buren, Arkansas, Police Department is placed under a Van Buren, Arkansas, Police and Fire Departments Civil Service, pursuant to Ark. Code Anno. 14 -51 -101 et seq. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS: ARTICLE 1. Pursuant to the provisions of Ark. Code Anno. 14 -51 -101 et seq, the same being Act 28 of the Acts of the Arkansas Legislature of 1933, as amended, the Van Buren, Arkansas, Police Department, in accordance with the provisions thereof, is placed under the Civil Service Commission of Van Buren, Arkansas, established under the provisions thereof. ARTICLE 2. Pursuant to the provisions of Ark. Code Anno. 14 -51 -101 et seq, the same being Act 28 of the Acts of the Arkansas Legislature of 1933, as amended, the existing Civil Service Commission of Van Buren, Arkansas, which presently only operates as to the Van Buren, Arkansas, Fire Department, shall be the Civil Service Commission of Van Buren, Arkansas, as to both the Van Buren, Arkansas, Police and Fire Department Civil Service Commission. ARTICLE 3. All provisions of Ark. Code Anno. 14 -51 -101 et seq, the same being Act 28 of the Acts of the Arkansas Legislature of 1933, as amended, are hereby adopted and, by reference, become a part of this ordinance. ARTICLE 4. This Ordinance shall be severable, and should any part hereof be declared to be invalid, for any reason, all other provisions that may be effective, without the invalid portions ti hereof shall remain in full force and effect. ARTICLE 5. All ordinances, and parts of ordinances, in conflict with this ordinance, are hereby repealed. ARTICLE 6. This ordinance shall not be effective, unless, and until, approved by the voters of the City of Van Buren, Arkansas, at the November, 1992, City General Election, and if so adopted by said voters, shall be and become effective on January 1, 1993. ARTICLE 7. This ordinance is hereby referred to the voters of the City of Van Buren, Arkansas, to be on the November, 1992, City General Election Ballot. ARTICLE 8. The ballot title to be used at such election shall be substantially in the following form: "FOR the adoption of a Civil Service System for the City Police of the City of Van Buren, Arkansas." "AGAINST the adoption of a Civil Service System for the City Police of the City of Van Buren, Arkansas." PASSED AND APPROVED THIS 15TH DAY OF JUNE, 1992. �QO ALLEN R.
