ORD NO 08-1993 CITY OF VAN BUREN, ARKANSAS ORDINANCE NO. -1993 AN ORDINANCE AMENDING SUB DIVISION ORDINANCE NO. 14 -1991 WHEREAS, The Van Buren Planning Commission desires to revise the Sub Division Ordinance to require the filing of additional copies of Preliminary and Final Plats; and WHEREAS, A Public Hearing has been held as required by law and the Planning Commission has recommended said revision to the Van Buren City Council for approval: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS: SECTION 1: THAT henceforth, Article II, Section A -1 of said Ordinance shall read as follows: "The Subdivider shall submit to the Planning Commission fifteen (15) copies of a preliminary plat, together with the pertinent supporting data, at least twenty (20) days prior to the meeting of the Planning Commission at which consideration is requested. A subcommittee of the Planning Commission will review the preliminary plat at least seven (7) days prior to the Planning Commission meeting, and make recommendations to the Planning Commission on the availability of utility easements, and street right -of- way to serve the property under consideration." SECTION 2: THAT henceforth, Article II, Section B -2 of said Ordinance shall read as follows: "Fifteen (15) copies of the final plat shall be submitted to the Planning Commission for review. The final plat shall be drawn at a scale of 1" 100' or larger, and shall be on a sheet size of 18 "X24" or 24 "X36 SECTION 3: THAT henceforth, Article II, Section B -7 of said Ordinance shall read as follows: "Pursuant to Section 5 -C, Arkansas Planning Law, Act 186 -1957, "the County Recorder shall not accept any plat for record without the approval of the Planning Commission." Following approval of the Planning Commission and acceptance by the City Council, if the property is located within the City, seven (7) copies of the Final Plat shall be filed with the County Recorder. SECTION 4: THAT the filing of additional copies as set forth herein, is necessary for the Planning Commission to effectively and efficiently supervise the orderly growth of the City, therefore, implementation of this Ordinance is necessary for the immediate preservation of the public peace, health and safety and an emergency is declared and this Ordinance shall take effect and be in full force after its passage.
