There is one more wrinkle to this current question and rezoning application that the Planning Conunission was curious abut with regard to the spot zone. The applicant is submitting a rezoning application for a planning zoning district (PZD) so that they can address some concerns of surrounding properly owners. The PZD is an"enhanced"version of our current conventional R-2 zoning district. The enhancements include architectural specifications for the buildings, lot size is bigger, landscaping, lighting controls, and maybe a few other items. I have attached their application that includes their pzd booklet which is the attached Word document. My experience is that this is still not a spot zone and falls within the parameters of the R-2 zone which is the Residential classification on the inaster street plan. To support my position the PC asked that the City Attorney confirm that the PZD is as I described and not a spot zone. Can you confirm. Let me know if you have any questions. While both involve the same property, the requested zoning classifications are materially different, and that distinction is significant in analyzing whether the current request constitutes impermissible spot zoning. Arkansas courts have recognized that spot zoning is not simply the rezoning of a single parcel. Rather, it generally refers to the rezoning of a small tract in a manner that is inconsistent with the municipality's comprehensive land use plan and undertaken primarily for the private benefit of the property owner rather than to further legitimate public planning objectives. In Smith v. City of Little Rock, the Arkansas Supreme Court noted that: "Spot zoning has been said to be invalid when it is primarily for the private interest of the owner of the property affected, and not related to the general plan for the community as a whole." The Court also reaffirmed that zoning decisions are legislative acts and will not be disturbed unless they are shown to be arbitrary, capricious, or unreasonable. Likewise, in PH, LLC v. City of Conway, the Court reiterated that municipalities are afforded broad discretion in making zoning decisions, and judicial review is limited to determining whether that discretion has been exercised arbitrarily or without a rational basis. Based on the information you provided, the current request appears distinguishable from the 2019 application. The Master Land Use Plan designates this area for Single Family/Duplex development. As you noted, both the existing R-1 district and the proposed R-2 district are consistent with that land use designation. By contrast, the 2019 request sought R-3 Multi- Family zoning, which represents a higher-density residential classification corresponding to a different land use category under the Master Land Use Plan. Consistency with the City's comprehensive planning documents is an impc'tan.t consideration in evaluating whether a rezoning constitutes unlawful spot zoning. Accordingly, assuming the current proposal is consistent with the adopted Master Land Use Plan and otherwise satisfies the City's planning objectives, do not believe the fact that a single parcel is being rezoned, standing alone, renders the request impermissible spot zoning. We had a lively discussion last night about a requested rezoning on a property where a similar but not exactly the same rezoning was requested in May 2019. The current request is to change the zoning from R-1 Single Fancily residential district to R-2 two family residential district. The attached PC packet has several maps showing the area and the proposed development. The May 2019 request was to change the zoning from R-1 single family to R-3 Multi-family residential district. The big difference is that R-2 allows single family or duplex but each principal structure has to be on an individual lot which is significantly different from a multi-family development where all buildings are on one lot. The R-3 also has higher density. In 2019 the rezoning was denied for several reasons including a statement from the City Attorney that the rezoning was spot zoning. Last night the neighborhood was really pushing that the proposed R-2 zoning and proposed duplex development(on individual lots)was also spot zoning. I contend that it was not spot zoning. The property is located in the Single Family/Duplex area of the Master Land Use Plan(see page 4G of the packet and the attached 2009 MLUP). The two zoning classifications of R-1 and R-2 fit within the Single Family/Duplex MLUP classification. My experience and expertise tells me that this is not a spot zoning because it fits the MLUP. The 2019 zoning classification was in my opinion a spot zoning request because there is a separate classification on the Master Land Use Plan for Multi-Family. Since our minutes of the May 2019 meeting(see page 4C of the PC Packet) has a statement from the City Attorney that has confused this matter, the PC asked if we could get a clarification from the City Attorney about this current rezoning. If there are any changes between now and then, I will make sure to send out an updated Booklet to you all. In the meantime, feel free to send in language/restrictions you would like to see added to the PZD. This could be items such requirements for lighting on-site or even changing the facade design of the development as discussed last week. At approximately 5:30 P.M., at 1212 Main St. Van Buren,AR(Take it Up-4 Knotch Events& Parties) the neighborhood meeting for the project between 1110-1118 Rena Rd. commenced. Jackson Goodwin with Goodwin Engineering introduced the PZD process, the proposed PZD, and development plans for the property.Mr. Goodwin discussed traffic in the area,master land use designations, nearby zoning,and utilities in the area. He discussed the differences between R-1,R-2,and the proposed PZD zoning, talking in length about the enhancements the proposed PZD allows the City to hold the developer to.The meeting was then opened up to comment from the attending neighboring property owners including recommendations on what they wanted to see addressed in the proposed PZD. There were approximately(12)neighboring property owners in attendance. Below is a list of comments that were brought up during the open discussion. Mr. Goodwin(Goodwin Engineering)and Dylan Wilson(Developer)answered the neighbors questions. 1) One concern from the Neighbors was the size of the pond. They stated that they wanted a larger pond that would capture more water, including that of their own properties. a. Mr. Goodwin stated the the pond exceeds all City of Van Buren design requirements but that the design team would continue to look for ways to enhance the detention pond design. 2) Neighbors also raised concerti about the uniform look of the housing in the plan. They stated it would not blend into their neighborhood. They didn't like the color of the buildings. The Neighbors stated that they would like frill brick or stone houses. Some concern about the elevation of the buildings were also stated. a. Mr.Wilson informed them about the properties on 1118 and l 110 Rena Rd,Van Buren,AR 72956 stating they looked very similar to what he was going to build and would blend well with them. b. Mr. Wilson invited the neighbors to provide their input on what they would want the development to look like several times throughout the open discussion. 3) The neighbors stated they wanted fencing around the whole property for privacy reasons. a. Mr. Wilson told them that it might be something he could look into in the fixture but also noted he would not want to remove all of the trees located along property lines. 4) Concerns about an increase in traffic flow was brought up. Concerns about getting out of their-driveways and slow-moving traffic was stated. a. Mr. Goodwin told them that, by his calculations, an increase of about 1.1% in traffic is expected.He also noted City Master Street Plans show Rena Rd, to eventually get expanded. 5) Some were worried about water pressure and if the new housing would lower it. a. Mr. Goodwin stated a basis of design showing expected design pressures will be created but that has not been completed yet. 6) Neighbors wanted the notice for the zoning change to be posted on the property. Mr. Goodwin told them that it is up to the city to put those out, but he will reach out to theni to get it posted. 7) A few of the neighbors said that they wanted to keep the old growth pines that were growing on the property,and worried that the work on the property will take them down. a. Mr. Wilson told them that he didn't want to take the trees down because lie loves trees. He did inform them though that if they Nvanted a fence posted around the property,the trees would potentially have to come down in order to build it. 8) There were a lot of concerns about tight pollution. Neighbors were worried that incoming cars and street lights would bleed light into their back yards and into their houses. a. Mr. Goodwin stated that the old growth trees would help keep light pollution from getting into their back yards, and he could include extra trees to be planted in order to further reduce the problem. b. Mr. Goodwin stated that neighbors could send in lighting restrictions they wanted to see for the Development and they could potentially be added to the PZD 9) Many neighbors went on to state that they did not like that there would be a common area and bus stop pad on the plans. They were worried that it would cause people to gather there that they considered bad for the neighborhood. a. Mr.Wilson went on to say that he would be willing to take those out of the plan. 10)Some were worried about where the storm drainage would go. They said that some drainage was moving across the road. a. Mr. Goodwin then told them that it would tie into a storm drainage box along Mitzi Ln. 11)One lady was worried about a transformer box that was sitting in her property,and if it would need to be moved. a. Mr.Wilson told her that they did not plan on moving it if they do not have to. 12)People at the meeting then asked to be sent a Booklet,PZD and the notes of what happened at the meeting. a. Mr. Goodwin then responds that if they put their email down in the sign in sheet at the meeting,he will gladly send that information out. 13)Many neighbors then went on to say that they wanted an upgrade on landscaping because they would miss the beauty of the empty lot. a. Mr.Wilson then told them that he would be willing to do an upgrade and add some more visually appealing landscaping. He said he would take any suggestions on what plants they would want added to help make it look beautiful. 14)There were a few concerns about the current sewage issue. They stated that there was backflow,and when it rained it would come up and overflow onto the property.An existing SSO problem downstream. a.
