ORD NO 28-2026 - DENIED CITY OF VAN BUREN,ARKANSAS -19 ORDINANCE NO. -2026 BE IT ENACTED BY THE CITY COUNCIL, FOR THE CITY OF VAN BUREN, ARKANSAS AN ORDINANCE TO BE ENTITLED: AN ORDINANCE FOR THE PURPOSE OF REZONING CERTAIN PROPERTY IN THE CITY OF VAN BUREN, ARKANSAS, AMENDING THE ZONING MAP OF THE CITY OF VAN BUREN, ARKANSAS, AND FOR OTHER PURPOSES. WHEREAS, the City of Van Buren,Arkansas,is duly incorporated under the law of the State of Arkansas, with all powers, authority, and duties of a city of the first class; and WHEREAS, the City of Van Buren has adopted the Zoning Ordinance for the City of Van Buren(Ordinance No. 7-1963); and WHEREAS, a request has been made by Mourning Wood, LLC to rezone certain property within the city limits of the City of Van Buren; and WHEREAS, the Planning Commission held a public hearing that was duly published in the Times Record on July 19,2026,and the public hearing was conducted as required by law(A.C.A 14-56-422) on August 4,2026; and WHEREAS, as a result of this hearing, the Planning Commission recommended that certain property within the city limits of the City of Van Buren be rezoned from its previous classification to the following: Property Zoned New Zoning R-1 Family Residential District Planned Zoning District(PZD) Legal Description: (Exhibit A) WHEREAS, the proposed rezoning herein was recommended by a majority vote of the entire Planning Commission, in accordance with A.C.A. 14-56-422. The application was submitted by Goodwin Engineering as agent for Mourning Wood,LLC. The purpose of the rezoning is to change the zoning of the property from R-I Single Family to a Planned Zoning District(PZD). The zoning change will facilitate the construction of a new subdivision that will have 6 lots allowing a residential duplex building on each lot. Goodwin engineering applied to change the rezoning from R-1 single family to R-2 family residential which was discussed at the July 7, 2026,Planning Conunission meeting. The Planning Conunission had a lengthy discussion about this proposed rezoning and eventually tabled the application suggesting both sides meet and look for common ground to address the concerns and possibly bring back a PZD which could put more requirements on the property than what might exist through a conventional rezoning to R-2 where the development would only have to meet the minimum city requirements. A neighborhood meeting occurred on July 16, 2026,and the PZD application was submitted and reviewed by the Planning Conunission at their August 4, 2026, meeting. The PZD is based on the conventional R-2 zoning district but with several enhancements or additional requirements. Table J in the PZD booklet shows the enhances or additional requirements. Before the meeting,the Planning Conunission had received the PZD documents for the proposed development, legal information concerning the claims of spot zoning,preliminary subdivision plans, the neighborhood meeting minutes, and an email from Randall Carter of 2013 Falls Branch Ln. (A copy of the Planning Counnrission packet is enclosed) After listening to a presentation from staff, Goodwin Engineering and those that were present in opposition to the rezoning,the Planning Conunission believed the proposed development with development conditions such as the PZD was much better than an unplanned and conventionally zoned situation as currently exists with the R-1. The Planning Commission spent considerable time engaging in a discussion with the developer and the neighborhood representatives. The neighborhood had discussed their concerns that are included in the neighborhood meeting minutes. The Planning Commission used those meeting minutes to ask the developer about adding the"tangible"items from the minutes to the PZD as further conditions of the PZD zoning.A lengthy discussion ensued which included agreement on the following items: • removing the park open space amenities (e.g. benches,BBQ grills, playground equipment, and bus stop, etc.). • revise all the building elevations to show exterior brick construction. • adding enhanced requirements concerning the exterior lighting in the subdivision. A consensus could not be reached regarding perimeter fencing because of the need to remove trees on the property line contiguous with some properties and the issue of not being able to fence easements. After this discussion,the Planning Commission voted.All members present voted to approve the PZD application and recommend the rezoning to the City Council. The Planning Commission members present were a majority of the Planning Commission as required by A.C.A. 14-56-422. Table J,which is on page 7 of the PZD booklet, lists the items that exceed or enhance this development over what a conventional R-1 zone would offer. The applicant had a neighborhood meeting to discuss and describe the PZD.A copy of the neighborhood minutes are enclosed. • Attached to this memo is a letter from Jackson Goodwin clarifying that diey formally request to withdraw the R-2 zoning application and that they are committed to this PZD application. • As with any new subdivision,should the rezoning be approved there are a few development issues that will be addressed including but not necessarily limited to: o eater and sewer improvements will be required.A copy of an email from VBIvIU is enclosed in the section about the preliminary subdivision plans. o Drainage improvements will be required.A drainage report and plans will be submitted and reviewed by our civil engineer consultant.A preliminary review is covered by an email that is enclosed in the section about the preliminary subdivision plans. o A subdivision plat will be required that will include the preliminary plat, infrastructure reviews,approval of construction plans and final plat approval. . o A complete review by all departments for compliance with all city development, constriction and fire codes will be required. o Preliminary plans have been submitted and reviewed.The project booklet mentions these improvements in paragraph d., section VI (page 3 of the booklet). • A staff review of the PZD reveals that the proposed PZD exceeds the minimum requirements of a conventional R-2 zoning district.The enhancements are summarized in paragraph j (page 7 of the booklet). • Previous discussions about spot zoning have been reviewed with the City Attorney.A copy of the email correspondence between the City Attorney and me are enclosed. (See attached Land use plan).R-1 and R-2 zoning districts are allowed in this land use classification. o The 2019 rezoning request was for an R-314uld-Family zoning.The Master Land Use Plan has a specific land use designation for Multi-Family.This is distinctively different from the current Land Use designation of Single Family/Duplex.That is why the 2019 rezoning request was considered as a spot zoning. o The proposed PZD maintains the minimum requirements of the R-2 zoning district and further includes added enhancements and is therefore allowed in the Single Family/Duplex land use classification and does not represent a spot zoning issue. • Goodwin Engineering,LLC prepared preliminary subdivision plans to show the proposed construction details of the subdivision.These preliminary plans have been shared with Van Buren Municiipal Utilities and our.Civil Engineering consultant.
