BE IT ENACTED BY THE CITY COUNCIL, FOR THE CITY OF VAN BUREN,
ARKANSAS,A RESOLUTION TO BE ENTITLED:
A RESOLUTION TO AMEND RESOLUTIONS 10-5-2022 and 7-5-
24, AUTHORIZING ENGINEERING SERVICES FOR THE
DOWNTOWN VAN BUREN DRAINAGE IMPROVEMENTS
GRANT PROJECT.
WHEREAS, Pursuant to Resolution 10-05-2022,the Van Buren City Council authorized the Mayor to
enter into an agreement with Hawkins-Weir Engineers, Inc., for the Downtown Van
Buren Drainage Improvements Grant Project; and
WHEREAS, Amendment No.1 to the initial agreement was approved by City Council on July 22,
2024,totaling$138,970.00.
WHEREAS, Amendment No.2 to the initial agreement has been submitted totaling$170,920.00.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
VAN BUREN,ARKANSAS,THAT:
SECTION 1: The Mayor is hereby authorized to pay Hawkins-Weir Engineers, Inc. $170,920.00 for
engineering services, as set forth in Exhibit "A" hereto, for all engineering expenses
relating to the Downtown Van Buren Drainage Improvements Grant Project.
IN WITNESS WHEREQN, the City f Van Buren, Arkansas, by its City Council, did pass,
approve, and adopt, by a vote of or and against,the foregoing Resolution at its regular meeting
held on the 27t'day of July 2026.

Dear Mayor Hurst:
We respectfully request an amendment to our Agreement for Professional Services, dated February
23, 2022, for the referenced project. This amendment provides for additional Construction Phase Services
added to the project. A detailed scope of the proposed engineering services is included in Amendment No.
2.
The original construction contract with Goodwin, Inc. included a 180-day contract period. Our
Construction Phase Services Amendment No. 1 included construction observation and general construction
phase services based on that period of work. During the project, 177 days have been added through
change work orders, including coordination with the Downtown Water Line Relocation project and additional
drainage work.
We propose increasing our contractual not-to-exceed (NTE) fee by $31,950.00 and continuing to
bill the City of Van Buren in accordance with our current Standard Hourly Billing Rate Schedule. If this
amendment is approved, our NTE fee will increase from $138,970.00 to $170,920.00, plus subconsultant
fees and reimbursable expenses.
If the City of Van Buren finds this proposed amendment acceptable, please sign and return a copy
of the enclosed Amendment No. 2 for our records.

HAWKINS-WEIR ENGINEERS,INC.
VAN BUREN,ARKANSAS
In accordance with the AGREEMENT for PROFESSIONAL SERVICES for the Downtown Van Buren
Drainage Improvements Grant Project,Project No.2021136,dated February 23,2022,between the City
of Van Buren,Arkansas(hereinafter called Owner)and Hawkins-Weir Engineers, Inc. (hereinafter called
Engineer), Owner hereby authorizes Engineer to proceed with the following services:
SECTION 1—SCOPE OF SERVICES
1.1 Amendment No.2 defines additional engineering services under the Agreement associated with the
Owner's project,Downtown Van Buren Drainage Improvements Grant Project.Additional Services include
the following items:
1. Periodic Construction Observation
2. Prepare Monthly Payment Requests
3. Coordinate relocation of public utilities
SECTION 2—TIME OF SERVICE
2.1 The scope of services as defined above is based on an additional contract construction period of 177
calendar days for the Owner's project, Downtown Van Buren Drainage Improvements Grant Project,
generally to include,unless otherwise noted in the Scope,periodic inspection based on an estimated 8 hours
of Inspection time per week over the contract construction period plus Construction Phase Services performed
by the Project Engineer. Construction phase services under this contract amendment are based on
construction work being continuous throughout the construction period. Engineer will proceed with
providing the services set forth herein immediately upon execution of this Amendment No.2 by all parties.

SECTION 3—COMPENSATION
3.1 Owner shall compensate Engineer for providing the services set forth herein in accordance with the
terms of the Agreement. Total payment for the Scope of Services described herein shall not exceed ThiM-
One Thousand Nine Hundred Fifty and 00/100 Dollars ($31,950.00) without written approval of Owner.
These Additional Services adjust the Agreement's not to exceed fee to$170,920.00.

INTO A CONTRACT FOR ENGINEERING SERVICES FOR THE
CITY OF VAN BUREN, ARKANSAS, AND FOR OTHER
PURPOSES.
WHEREAS, the City of Van Buren, Arkansas desires to make various improvements within the City
to include streets, drainage,bridges and sidewalks; and
WHEREAS, in order to commence the projects and to seek grant funding, the City is in need of
professional engineering services for the development of plans and designs, cost
estimates, and supervision for said projects.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
VAN BUREN,ARKANSAS,THAT:
SECTION l: The Mayor is authorized to enter into a contract (Exhibit "A') with Hawkins-Weir
Engineers, Inc. to provide engineering services for the development of preliminary
engineering and designs, and cost estimates for the above listed projects. Payment for
such engineering services shall not exceed $50,270.00 plus any applicable reimbursable
expenses.
IN WITNESS WHEREOF, the City of Van Buren, Arkansas, by its City Council, did pass,
