ORD NO 30-1994 CITY OF VAN BUREN, ARKANSAS 1994 ARKANSAS ENERGY CODE ORDINANCE NO 0 -1994 AN ORDINANCE PROVIDING MINIMUM REQUIREMENTS FOR THE DESIGN OF NEW BUILDINGS AND STRUCTURES OR PORTIONS THEREOF AND ADDITIONS TO EXISITING BUILDINGS THAT PROVIDE FACILITIES OR SHELTER FOR PUBLIC ASSEMBLY, EDUCATION, BUSINESS, MERCANTILE, INSTITUTIONAL, STORAGE, AND RESIDENTIAL OCCUPANCIES, AS WELL AS THOSE PORTIONS OF FACTORY AND INDUSTRIAL OCCUPANCIES DESIGNED PRIMARILY FOR HUMAN OCCUPANCY BY REGULATING THEIR EXTERIOR ENVELOPES AND THE SELECTION OF THEIR HVAC, SERVICE WATER HEATING, ELECTRICAL DISTRIBUTION AND ILLUMINATING SYSTEMS, AND EQUIPMENT FOR EFFECTIVE USE OF ENERGY. BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS: SECTION 1: ADOPTION OF ENERGY CODE. There is hereby adopted by the City Council of the City of Van Buren, Arkansas, for the purpose of establishing rules and regulations for energy efficient standards for new building construction, this code known as the 1994 Arkansas Energy Code, being particularly the 1994 edition thereof and the whole thereof, save and except such port- ions as are hereinafter deleted, modified, or amended, of which not less than three (3) copies have been and now are filed in the office of the City Clerk of the City of Van Buren, Arkansas, and the same are hereby adopted and incorporated as fully as if set out at length herein, and from the date on which this Ordinance shall take effect, the provisions thereof shall be controlling in the construction of all buildings and structures therein contained within the corporate limits of the City of Van Buren, Arkansas. SECTION 2. INCONSISTENT ORDINANCES REPEALED. Ordinances or parts thereof in force at the time that this Ordinance shall take effect and inconsistent herewith, are hereby repealed. SECTION 3: EMERGENCY CLAUSE. Whereas it is of the utmost urgency that the City of Van Buren, Arkansas, have an up -to -date Energy Code to protect the citizens of our city, therefore, an Emergency is hereby declared to exist and this Ordinance being necessary for the immediate protection of the public shall take effect immediately on its passage and approval. As a result of this public review, the existing 1979 standards have been upgraded to 1994 levels (1994 Arkansas Energy Code). Because the improved standards will help lower utility bills, it is expected that the improved code will ensure new homes and commercial buildings are more affordable, comfortable, and cost effective for owners and tenants. Effective October 1, 1994, home builders and building professionals responsible for observance of building codes will be required to comply with the 1994 Energy Code. Enforcement will rely upon a voluntary system of self- certification by the builder. Each builder will be required to place a signed certification seal on the inside of the building to identify that he or she has net the provisions of the 1994 Arkansas Energy Code. The adhesive seal must be placed on the heating or cooling equipment cabinet, or the electrical service panel, where it is readily visible to the building occupant and inspectors. Enforcement will begin February 1, 1995 so that builders and local jurisdictions will have time to adjust to the new regulations. The Arkansas Energy Office will provide code training and implementation support during this time period. Several years ago, our office surveyed local code officials. The results of the survey indicated that they wanted updated state building energy standards, more and better training, and improved communications between state and local offices. Along with the Arkansas Industrial Development Commission 1111'VII Lights_ One State Capitol Mall/ Little Rock, Arkansas USA 72201 (501) 682 1370 /FAX 501 -682 -7341 2 new energy standards, our office will be offering four training workshops around the state that will be open to all local energy code officials. We have also set up a toll free telephone number (1 -800- 558- CODE(2633) to assist builders and code officials outside the Little Rock area in code compliance. Builders and code officials in the Little Rock area may reach the Energy Office by calling 682 -6235. An information sheet is enclosed that identifies dates and locations of the training workshops, objectives of the code, and the toll free number to call for your questions. Also enclosed is a sample ordinance to facilitate adoption of the code to replace your current ordinance governing energy efficiency in new construction. Adoption of this ordinance is voluntary, but is encouraged so that homebuyers in your city can be assured that minimum energy efficiency standards are being met. A copy of the 1994 Arkansas Rules and Regulations for Energy Efficiency Standards for New Building Construction and an instructional packet will be mailed to you in the next few weeks.
