ORD NO 16-2026 CITY OF VAN BUREN,ARKANSAS ORDINANCE NO.1- 2026 BE IT ENACTED BY THE CITY COUNCIL, FOR THE CITY OF VAN BUREN, ARKANSAS, AN ORDINANCE TO BE ENTITLED: AN ORDINANCE TO ABANDON A PUBLIC STREET RIGHT OF WAY IN THE MOUNTAINVIEW ADDITION, INSIDE THE CITY OF VAN BUREN, CRAWFORD COUNTY,ARKANSAS. WHEREAS, a petition has been filed with the City Council of Van Buren,Arkansas, on the 23rd day of October,2025 by The Porches at Heritage LLC, Cynthia Mooney Revocable Trust and Ricky Mooney Revocable Trust asking the City of Van Buren to vacate and abandon all that portion of a public street right of way lying between Blocks L and D and Blocks E and D Mountainview Addition to the City of Van Buren, Crawford, County, Arkansas. WHEREAS, after due notice as required by law,the Council has heard all persons desiring to be heard on the question of abandoning the public street right of way in the hereinabove subdivision, and has ascertained that the public street right of way hereinabove designated has therefore been dedicated to the public use as a public street right of way and that the same has not been used for a period of more than five (5) years preceding this date; and that the owners of the property abutting the public street right of way to be abandoned have filed with the City Council or have expressed their consent to such abandonment and the public interest and welfare are not adversely affected by abandonment of said public street right of way; and WHEREAS, the City Council of Van Buren, acting under the authority of A.C.A. 14-199-103 and A.C.A. 14-301-302, has the authority to abandon public street right of ways or segments thereof. NOW, THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN,ARKANSAS, THAT: SECTION 1: The City of Van Buren, Arkansas, hereby releases, vacates, and abandons all its rights, together with the rights of the public generally, in and to the public street right of way specifically designated as follows in"Exhibit A." SECTION 2: A copy of this Ordinance bearing original signatures and duly certified by the City Clerk shall be filed in the Records of the Circuit Clerk of Crawford County, Arkansas. The petition is from The Porches at Heritage,LLC and Rick and Cynthia Mooney. The purpose of the Petition is to abandon a portion of the street rights of ways of Summit and Central Avenue so that the Mooney's property can be combined without the encumbrance of a platted but undeveloped street right of way. In accordance with Arkansas Statutes,the Van Buren City Council approved Resolution No. 12- 04-2025 which set the public hearing for January 26,2026. We distributed the application and maps to all utilities and city departments. Several utilities had requests for easements to replace the abandoned right of way. A subdivision plat has been submitted and is being reviewed. The plat will dedicate the necessary easements to cover the needs of the various utilities. The Planning Commission reviewed the application at their meeting on December 2, 2025.No one spoke in opposition to the request. The Planning Commission saw no planning issues with the request to close the undeveloped street right of way and voted unanimously to refer the application to the City Council contingent on all utility easements being dedicated where necessary to replace the right of way.
