ORD NO 12-2026 CITY OF VAN BUREN,ARKANSAS ORDINANCE NO.19..�-2026 BE IT ENACTED BY THE CITY COUNCIL,FOR THE CITY OF VAN BUREN,ARKANSAS AN ORDINANCE TO BE ENTITLED: AN ORDINANCE AUTHORIZING THE TRANSFER OF REAL PROPERTY;DECLARING AN EMERGENCY;AND FOR OTHER PURPOSES. WHEREAS, A.C.A. Section 14-54-304 permits cities to transfer properties to any political subdivision of the State. WHEREAS, the City of Van Buren,Arkansas("City")owns certain real property located within the city limits; and WHEREAS, the Van Buren School District ("School District') has requested the transfer of said property for educational and recreational purposes; and WHEREAS, the City Council finds that the transfer of said property to the School District will promote the public welfare and benefit the citizens of Van Buren; NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN,ARKANSAS,THAT: SECTION 1: Authorization of Transfer The Mayor and City Clerk are hereby authorized and directed to execute all necessary documents to transfer,convey,and assign the following described real property,owned by the City of Van Buren, Arkansas,to the Van Buren School District, for use in connection with its educational mission and related purposes. SECTION 2: Legal Description The real property to be transferred is more particularly described in Exhibit"A" attached hereto and incorporated herein by reference. SECTION 3: Terms and Conditions The transfer of the subject property shall be without monetary consideration,but subject to any restrictions, easements, or covenants of record and any conditions mutually agreed upon by the City and the School District,as set forth in the transfer documents. SECTION 4: Severability If any section,clause,or provision of this ordinance is found to be invalid or unenforceable, such invalidity or unenforceability shall not affect the remaining provisions, which shall continue in full force and effect. SECTION 5: Emergency Clause It is hereby found and determined that there is an immediate need for the transfer of the above-described real property to the Van Buren School District in order to promote the public welfare and ensure the timely advancement of educational purposes within the City of Van Buren. Therefore, an emergency is declared to exist, and this ordinance being necessary for the immediate preservation of the public peace,health, and safety shall be in full force and effect from and after its passage and approval.
