BE IT ENACTED BY THE CITY COUNCIL, FOR THE CITY OF VAN BUREN,
ARKANSAS AN ORDINANCE TO BE ENTITLED:
AN ORDINANCE TO AMEND ORDINANCE NO. 7-1963
(VAN BUREN MUNICIPAL CODE NO.14.04.04) FOR THE
PURPOSE OF REZONING CERTAIN PROPERTY IN THE
CITY OF VAN BUREN, ARKANSAS, AMENDING THE
ZONING MAP OF THE CITY OF VAN BUREN,ARKANSAS,
AND FOR OTHER PURPOSES.
WHEREAS, the City of Van Buren,Arkansas, is duly incorporated under the law of the State of
Arkansas, with all powers, authority, and duties of a city of the first class; and
WHEREAS, the City of Van Buren has adopted the Zoning Ordinance for the City of Van Buren
(Ordinance No. 7-1963); and
WHEREAS, a request has been made by Meltem Properties, LLC to rezone certain property
within the city limits of the City of Van Buren; and
WHEREAS, notice of a Public Hearing was duly published in the Southwest Times Record on
December 21,2025, and a public hearing was conducted as required by law(A.C.A
14-56-422)on January 6, 2026; and
WHEREAS, as a result of this hearing, the Planning Commission recommended that certain
property within the city limits of the City of Van Buren be rezoned from its previous
classification to the following:
Current Zoning New Zoning
Commercial-2 Residential-3
Thoroughfare Commercial District Multi-Family Residential District

WHEREAS, the proposed rezoning herein was recommended by a majority vote of the entire
Planning Commission, in accordance with A.C.A. 14-56-422.
NOW,THEREFORE,BE IT ORDAINED AND ENACTED BY THE CITY
COUNCIL OF THE CITY OF VAN BUREN,ARKANSAS,THAT:
SECTION 1: The above-described property is hereby rezoned from C-2 to R-3 and the Van Buren
Zoning Map is hereby amended to reflect this rezoning.
IN WITNESS WHERE the City of Van Buren,Arkansas, did pass, approve, and
adopt, by a vote of�for and against,the foregoing Ordinance at its regular meeting held
on the 91h day of February 2026.

SUBJECT: REZONING—LOT 6,BLOCK 2, EDGEWOOD PLACE (19 & 21 SOUTH
14TH STREET)

The subject rezoning application was submitted to the City for the purpose of rezoning the
subject property. The application was submitted by Satterfield Land Surveyors as agent for
Meltem Properties,LLC.
The purpose of the rezoning is to change the zoning from C-2 to R-3. The property is currently
developed as a residential duplex and has been developed as a residential duplex for
approximately 23 years. Commercial zoning on the property does not allow residential duplex
making this duplex a nonconforming use for the C-2 zoning district. Meltem Properties,LLC
wants to sell the property but lenders will not process a loan since the property is not properly
zoned for the residential duplex. I recommended the best way to resolve the situation is to seek a
zoning correction to R-3 so that it matches the current land use on the property. There are several
properties zoned R-3 including across the street and contiguous residential uses to satisfy any
concerns about the R-3 zoning.
The Planning Commission held their public hearing for this rezoning request on January 6, 2026.
Mr.Dana Roza was present in support of the application. Mr. Andy Greenwood spoke in
opposition to the rezoning.
The Planning Commission members that were present at the meeting voted unanimously to
recommend the City Council amend the zoning map by approving this rezoning request of
Meltem Properties,LLC. The Planning Commission members present were a majority of the
Planning Commission as required by A.C.A. 14-56-422.
I have attached the documents submitted by the applicant and all information reviewed by the
Planning Commission with the draft of the Planning Commission minutes.

STAFF COMMENTS
The applicants want to have the property zoned to match die property use.Recently I was contacted
by an appraiser and a lender about the zoning of this property.The existing C-2 zoning does not
permit a duplex therefore it is considered an existing non-conforniing land use. If the duplex is
damaged or destroyed by more than 50 percent,rebuilding die duplex will require conditional use
to be approved by the Planning Conunission or a rezoning.The lender did not want to make the
loan on the property because of this issue.After discussing with die applicant, we can support a
zoning change from,the existing C-2 to R-3 since there are other properties with the R-3 zoning

contiguous to this property and the land uses are consistent with residential uses in the vicinity of
this property.
We recommend the Planning Commission approve the zoning change to correct die zoning
situation dint exists with the existing duplex.
