RES NO 08-02-1994 CITY OF VAN BUREN, ARKANSAS RESOLUTION NO. e- -1994 A RESOLUTION GRANTING AN EXCEPTION FROM THE SUB- DIVISION REGULATIONS. WHEREAS, Gerald Price, the owner of certain real property located within the Van Buren Industrial Park has petitioned the City of Van Buren to be allowed to reconfigure a portion of Lot 3, Crawford County Industrial Park, Phase II without the necessity of re- platting the lot and to sell said reconfigured property using a metes and bounds description, and WHEREAS, Section V, Subsection A regarding variances allows exceptions to compliance with the Sub Division Regulations where conditions exist whereby compliance would cause a substantial hardship on the subdivider and the granting of the variance or exception would not result in undermining the intent of the Sub Division Regulations. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS. SECTION I: THAT there exists sufficient unique conditions associated with the above described property that compliance with the Sub Division Regulations would create a substantial hardship upon the subdivider and that the granting of an exception or variance from the Regulations would not result in undermining the intent of the Regulations. SECTION II: THAT the subdeveloper, Gerald Price, is granted an exception and variance from the requirement of re- platting the real property located in Lot 3, Crawford County Industrial Park, Phase II and is therefore allowed to re- configure said lot and to sell a portion of said lot by metes and bounds description.
