BE IT ENACTED BY THE CITY COUNCIL,FOR THE CITY OF VAN BUREN,
ARKANSAS,A RESOLUTION TO BE ENTITLED:
A RESOLUTION SETTING A PUBLIC HEARING DATE FOR
ABANDONING A PUBLIC STREET RIGHT OF WAY IN THE
MOUNTAIN VIEW ADDITION INSIDE THE CITY OF VAN BUREN,
CRAWFORD COUNTY,ARKANSAS.
WHEREAS, Rick and Cynthia Mooney,represented by Satterfield Land Surveyors,has petitioned the
City Council of Van Buren,Arkansas,to vacate and abandon a portion of the public
street right of way known as Summit Avenue and Central Avenue rights of ways lying
between Blocks L and D and Blocks E and D Mountainview Addition to the City of Van
Buren,Crawford County,Arkansas more particularly described as follows:
Description of Existing Street Right of Way
Part of Summit Avenue and Central Avenue right of ways lying between Blocks"L" and
"D" and Blocks "E" and"D",Mountain View Addition to the City of Van Buren,
Crawford County,Arkansas being more particularly described as follows:
Beginning at an existing rebar marking the Northwest Corner of Lot 1,Block"D".
Thence along the West line of said Lot 1, South 02 degrees 15 minutes 16 seconds West,
50.49 feet to a set rebar with cap. Thence leaving said West line,North 86 degrees 11
minutes 59 seconds West, 81.37 feet to a set rebar with cap marking the Southeast Corner
of Lot IA,Block"E". Thence along the East line said Lot lA following bearings and
distances:North 03 degrees 40 minutes 45 seconds East, 127.97 feet to a set rebar with
cap. South 86 degrees 09 minutes 55 seconds East, 80.00 feet to a set rebar with cap.
North 03 degrees 40 minutes 45 seconds East,30.00 feet to a set rebar with cap. Thence
leaving said East line, South 86 degrees 09 minutes 55 seconds East, 322.00 feet to a set
rebar with cap. Thence South 02 degrees 08 minutes 16 seconds West, 82.12 feet to a set
rebar with cap marking the Northeast Corner of Lot 13,Block"D". Thence along the
North line of Lots 13 through 1, Block"D", South 89 degrees 48 minutes 26 seconds
West, 325.00 feet to the Point of Beginning,containing 0.94 of an acre and subject to any
Easements of Record.
WHEREAS, all the property owners and adjacent property owners being affected by this street right of
way abandonment have consented by signed petition;and
WHEREAS, the City Council of Van Buren, acting under the authority of A.C.A. 14-199-103 and
A.C.A. 14-301-302,has the authority to vacate public street rights of way or segments
thereof
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
VAN BUREN,ARKANSAS,THAT:
SECTION 1: A Public Hearing is set for December 22,2025,at 5:30 P.M. in the Van Buren City
Council Room, at which time said Petition shall be presented to the City Council and the
City Council will determine at that time if such portion of said public street right of way
should be vacated and that all affected property owners and other persons directly
interested have consented to such vacating.
SECTION 2: The City Clerk of Van Buren,Arkansas, is hereby directed to give notice by publication
once a week for two consecutive weeks in some newspaper,published in Crawford
County,advising the property owners and others affected,of said date and time the
Council will hear said Petition.
IN WITNESS WHEREOF,the City o Van Buren,Arkansas,by its City Council,did pass,
approve,and adopt,by a vote of a for and J6 against,the foregoing Resolution at its regular meeting
held on the 241 day of November 2025.

SUBJECT: PUBLIC RIGHT OF WAY ABANDONMENT(A PORTION OF SUMMIT
AND CENTRAL STREETS)
DATE: NOVEMBER 17,2025
Rick and Cynthia Mooney have requested the abandonment of an existing public street right of
way. This existing right of way is an undeveloped public street.
Arkansas Code Annotated(A.C.A.) 14-199-103 gives cities such as Van Buren the power and
authority to vacate public utility easements by following procedures found in A.C.A. 14-301-301
through 14-301-306. Rick and Cynthia Mooney,through their agent Satterfield Land Surveyors
has submitted a petition in accordance with these requirements.
A.C.A. 14-301-302 (c)requires the City Council to fix a day for the hearing of the petition. A
Resolution setting the public hearing date for the December 22, 2025, City Council meeting has
been prepared and will be presented to the City Council at the November 24, 2025, meeting.
We are currently having their request reviewed by public utilities and city departments. Any
concerns will be addressed and made known at the December 22, 2025, city council meeting.

Crawford Coanty,Arkansas,a muciicipal corporation,petition to vacate ree fights of Way
which is described as follows:

That tite abutting real estate affected by said abandonment of the Rights of Way are
are currently Not Opened ,and that the public interest and
welfare would not be adversely affected by the abandonment of the above-described
rights of way ,and that the rights of way has not been used by the public
for a period of at least five(5)years.
The petitioners request that tile,City of Van Buren,Arkansas,abandon and vacate the above-described
real estate,subject to existing public utility easement,water line easements,sewer easements,or drainage
easements as required,and that the above-described real estate be used for the respective benefit and
put-pose as now approved by law.
The petitioners further request that the above-described real estate be vested in the abutting property

with the city staff and/or franchisees have determined that no utility easement is necessary.

City Council meeting. Before the public hearing, the petition will be referred to the
Subdivision Review Committee and then to the Planning Commission for recommendation
