BE IT ENACTED BY THE CITY COUNCIL, FOR THE CITY OF VAN BUREN,
ARKANSAS AN ORDINANCE TO BE ENTITLED:
AN ORDINANCE TO AMEND ORDINANCE NO. 7-1963
(VAN BUREN MUNICIPAL CODE NO.14.04.04) FOR THE
PURPOSE OF REZONING CERTAIN PROPERTY IN THE
CITY OF VAN BUREN, ARKANSAS, AMENDING THE
ZONING MAP OF THE CITY OF VAN BUREN,ARKANSAS,
AND FOR OTHER PURPOSES.
WHEREAS, the City of Van Buren,Arkansas, is duly incorporated under the law of the State of
Arkansas, with all powers, authority, and duties of a city of the first class; and
WHEREAS, the City of Van Buren has adopted the Zoning Ordinance for the City of Van Buren
(Ordinance No. 7-1963); and
WHEREAS, a request has been made by Scott Overby to rezone certain property within the city
limits of the City of Van Buren; and
WHEREAS, notice of a Public Hearing was duly published in the Southwest Times Record on
August 17, 2025, and a public hearing was conducted as required by law (A.C.A
14-56-422)on September 2, 2025; and
WHEREAS, as a result of this hearing, the Planning Commission recommended that certain
property within the city limits of the City of Van Buren be rezoned from its previous
classification to the following:
Current Zoning New Zoning
Residential-3 Commercial-1
Multi-Family Residential District Central Commercial District

Planning Commission, in accordance with A.C.A. 14-56-422.

COUNCIL OF THE CITY OF VAN BUREN,ARKANSAS,THAT:
SECTION I: The above-described property is hereby rezoned from R-3 to C-1 and the Van Buren
Zoning Map is hereby amended to reflect this rezoning.

The subject rezoning application was submitted to the City for the purpose of rezoning the
subject property. The application was submitted by Satterfield Land Surveyors as agent for Scott
Overby.

The purpose of the rezoning is to change the zoning from R-3 to C-1. At the Planning
E.
Commission meeting, Mr. Dana Roza of Satterfield Land Surveyors stated that the purpose of g
the rezoning is to allow the construction of a warehouse on the property.
The Planning Commission held their public hearing for this rezoning request on September 2nd, ?
2025. At the public hearing there were no adjacent property owners or anyone in opposition to
the proposed rezoning.
The Planning Commission members that were present at the meeting voted unanimously to
recommend the City Council amend the zoning map by approving this rezoning request of Scott
Overby. The Planning Commission members present were a majority of the Planning
Commission as required by A.C.A. 14-56-422.
I have attached the documents submitted by the applicant and all information reviewed by the
Planning Commission with the draft of the Planning Commission minutes.

5. Rezone #2-2025-319 South 91h Street—Scott Overby/Satterfield Land Surveyors;
Requesting Rezone From R-3 Multi-Family Residential District To C-1 Central Commercial
District. A motion to approve rezone recommendation to City Council was made by
Commissioner Mason Shirey and seconded by Commissioner Jay White. The motion was
approved unanimously.
The application included a site plan that shows a proposed 50'x100' metal storage building. The
letter in the application states that the owner, Scott Overby, plans to build a storage building and
rent out storage space. Dana Roza of Satterfield Land Surveyors was present at the meeting, on
behalf of Scott Overby, to answer questions the Commission had about the use of the proposed
storage building(only uses permitted in C-1 zoning district will be permitted in the building). Mr.
Roza stated that Mr. Overby wants to sell the property and that the potential buyer will store
construction supplies; there will be no outside storage,it will be for a warehouse use only.

A conceptual site plan is attached that shows a proposed 50'x 100'metal storage building. We have
the following bullet points for consideration: YA
• Only uses that are permitted in a C-1 zoning district will be permitted in the building.
• The property is not identified for commercial purposes on the Master Land Use Plan map.
• The development must comply with the city's flood damage code and FEMA regulations.
• A replat will be necessary to combine the two parcels/lots.
• Adequate parking design is necessary for the single driveway.The entire frontage cannot be
used as a driveway.
• The approval of the rezoning plan should not be considered approval of the construction
plans or development plan.Those plans must be submitted and approved before a building
permit is issued.
