BE IT ENACTED BY THE CITY COUNCIL,FOR THE CITY OF VAN BUREN,ARKANSAS,
A RESOLUTION TO BE ENTITLED:
A RESOLUTION OF INTENT REGARDING THE CITY OF VAN BUREN
MUNICIPAL UTILITIES 2025-2026 TANK REHABILITATION AND
RECOATING PROJECT.
WHEREAS, the City of Van Buren, Arkansas (the "City"), through the City of Van Buren
Municipal Utilities Commission (the "Commission"), proposes to acquire,
construct and equip improvements to the existing facilities of its water system(the
"System"), including particularly, without limitation, the Crestview Tank, the
Lovers Lane Tank, and the Dora Tank(the "Project"); and
WHEREAS, the City proposes to obtain funds to accomplish the Project from the proceeds of
water and sewer revenue bonds (the 'Bonds") to be issued by the City in the
maximum aggregate principal amount of $2,300,000 and purchased in multiple
advances by the Arkansas Development Finance Authority ("ADFA") as a part of
the Drinking Water State Revolving Loan Fund Program administered by the
Arkansas Natural Resources Commission(the "Program"); and
WHEREAS, the purchase price for the Bonds will be paid from proceeds of bonds issued by
ADFA or other federal or state funds made available by the Program; and
WHEREAS, the purpose of this Resolution is for the City to declare its "official intent" for the
reimbursement of certain expenditures, within the meaning of Regulation Section
1.150-2 promulgated by the United States Treasury Department(the "Regulation");
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF VAN BUREN,ARKANSAS,THAT:
SECTION 1. The City hereby expresses its official intent to authorize the Commission to
advance its own funds to pay costs of the Project, from the Water Capital
Improvement Fund, prior to the issuance of the Bonds and to reimburse itself from
proceeds of the Bonds. This Resolution shall be considered an "official intent" for
purposes of the Regulation.
SECTION 2. The City expects that, but does not limit, the sources of funds to be advanced for
the Project prior to issuance of the Bonds will be System revenues.
SECTION 3. A copy of this Resolution shall be filed in the official records of the City in the
office of the City Clerk within ten(10) days from the adoption hereof.
IN TESTIMONY WHEREOF,the Co of Van Buren, Arkansas, by its City Council, did pass,
approve, and adopt, by a vote of (P for and against, the foregoing Resolution at its regular meeting
held on the 25'day of August 2025.

A RESOLUTION RECOMMENDING THAT THE MAYOR AND CITY COUNCIL OF THE
CITY OF VAN BUREN,ARKANSAS AUTHORIZE THE CITY OF VAN BUREN
MUNICIPAL UTILITIES COMMISSION TO PROCEED WITH RESOLUTION(S) OF
INTENT REGARDING THE PARKVIEW DRIVE-WOODROW SEWER IMPROVEMENT,
28TH STREET INTERCEPTOR SEWER IMPROVEMENT,DOWNTOWN WATER SYSTEM
IMPROVEMENTS,AND 2025-2026 TANK REHAB AND RECOATING PROJECTS
WHEREAS,the City of Van Buren,Arkansas(City),owns a water works system and a
wastewater collection and treatment system,both operated,maintained, and administered by the
City of Van Buren Municipal Utilities Commission(Commission)pursuant to Ordinance 9-1965,
and
WHEREAS,The City and Commission have been approved to receive loans from the Arkansas
Department of Agriculture,Natural Resource Division for needed improvements to the City of
Van Buren Public Water and Sewer System, and,
WHEREAS,Procuring the loans for the improvements are absolutely necessary for the public
good and benefit in order to maintain the proper operation of the City's Public Water System.
NOW,THE, BE IT RESOLVED BY THE CITY OF VAN BUREN MUNICIPAL
UTILITIES COMMISSION,THAT:
The Commission hereby recommends that the City Council approve the attached
Resolution(s) of Intent to authorize the Commission to advance funds from the City
of Van Buren Municipal Utilities' Water and Sewer Capital Improvement Funds to
pay the cost of the Projects prior to the issuance of the Bonds and to reimburse the
funds from the proceeds of the Bonds.
