RES NO 08-03-2025 CITY OF VAN BUREN,ARKANSAS RESOLUTION NO. W - �2025 BE IT ENACTED BY THE CITY COUNCIL, FOR THE CITY OF VAN BUREN, ARKANSAS,A RESOLUTION TO BE ENTITLED: A RESOLUTION APPROVING AMOUNTS OF LIENS TO BE CERTIFIED TO THE CRAWFORD COUNTY TAX COLLECTOR AGAINST CERTAIN REAL PROPERTIES AS A RESULT OF GRASS CUTTING EXPENSES AND ABATEMENT OF OTHER NUISANCES BY THE CITY OF VAN BUREN; AND FOR OTHER PURPOSES. WHEREAS, in accordance with Ark Code Ann. § 14-54-901, the City of Van Buren has corrected conditions existing on certain lots or other real property within the City of Van Buren and is entitled to compensation pursuant to Ark Code Ann. § 14-54-904; and WHEREAS, State law also provides for a lien against the subject properties,with the amount of lien to be determined by the City Council at a hearing held after notice to the owner thereof by certified mail or publication (see Exhibit "A" attached hereto), with said amount (plus a ten percent collection penalty) to be thereafter certified to the Crawford County Tax Collector; and WHEREAS, a hearing for the purpose of determining such liens has been set for 5:30 p.m. on August 25, 2025, in order to allow-service of the attached notice of same upon the listed property owners,by certified mail or publication as is necessary. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN,ARKANSAS,THAT: SECTION 1. After notice to property owners, a public hearing was held at 5:30 p.m. on August 25, 2025, for the purpose of determining the amount of liens, if any, to be filed against certain real property as the result of grass cutting and abatement of other nuisances by the City of Van Buren. SECTION 2. After said public hearing the amounts listed on Exhibit "A" are hereby certified and are to be forwarded to the Crawford County Tax Collector. SECTION 3. This Resolution shall be in full force and effect from and after its passage and approval. Section 5.04.01 of the City's Municipal Code requires owners of all property to cut weeds, grass, remove garbage, rubbish and other unsanitary and unsightly articles and things from their property pursuant to Ark Code Ann. § 14-54-901.The City has the authority to do whatever is necessary to correct the conditions and to charge the costs thereof to the owner of lots or property who neglects or refuses to remove, abate or eliminate the condition after having been given seven (7) days written notice to do so. 2. On or about 3/13/25 the City gave notice to Juanita Watkins & Mauris Shultz, who is listed on the county land records as the owner of record of the herein reference property. More than seven days passed after notice was given. The City took bids to correct the condition upon the above- described property and on or about 6/2S/25 the condition was corrected, and the City incurred expenses as a result thereof. 3. After the work was completed, the City provided notice to the owner of record on or about 6/28/25 of the total amount of the clean-up totaling$759.68 Exhibit 1 attached hereto. The City has made demand for payment and given the applicable owner notice of the City's intent to file this lien. The owner has failed to make payment. No part of the debt has been paid and the City of Van Buren claims a lien including administrative and filing costs, on the herein referenced property pursuant to Ark Code Ann. § 14-54-901 and 14-54-903 in the amount of$88S.14 to secure the indebtedness.
