RESOLUTION NO.67 - 63-2025
BE IT ENACTED BY THE CITY COUNCIL, FOR THE CITY OF VAN BUREN,
ARKANSAS,A RESOLUTION TO BE ENTITLED:
A RESOLUTION AUTHORIZING THE MAYOR TO
EXECUTE AN EASEMENT IN FAVOR OF ARKANSAS
OKLAHOMA GAS CORPORATION.
WHEREAS, Arkansas Oklahoma Gas Corporation needs to replace old natural gas line
on City Park property to serve buildings in the City Park; and
WHEREAS, a gas utility easement is necessary to install the new natural gas line on
property at the City Park
WHEREAS, the installation of the gas line will benefit the citizens of the City of Van
Buren, the City Council believes it is appropriate to grant a gas utility
easement to Arkansas Oklahoma Gas Corporation.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF VAN BUREN, ARKANSAS,THAT:
SECTION 1: The Mayor is hereby authorized to execute the attached easement in favor
of Arkansas Oklahoma Gas Corporation for the installation of a pipeline for
the transportation of natural gas on property at the City Park as described in
the easement and the attached Exhibits A and B.
IN WITNESS WHEREOF, the.City of Van Buren, Arkansas, by its City Council, did
pass, approve, and adopt, by a vote of q—for against, the foregoing Resolution at its regular
meeting held on the 28t'day of July 2025.

GAS UTILITY EASEMENT
KNOW ALL MEN BY THESE PRESENTS:
That City of Van Buren.GRANTOR(S), for and in consideration by the Arkansas Oklahoma Gas
Corporation hereinafter called GRANTEE, the receipt of which is hereby acknowledged, do
hereby grant, bargain, sell, and convey to said GRANTEE, it's contractors and assigns, a
permanent easement for the construction, inspection, maintenance, repair, replace, relocate, and
abandon in place(in accordance with federal, state and local requirements)of public(GRANTEE
owned) gas utilities with all appurtenances thereto, together with the right to remove trees,
brushes,undergrowth or other obstructions(except any preexisting obstructions as of the time this
Easement is executed) interfering with construction, operation and maintenance of said gas
utilities over, under and upon the following lands situated in Van Buren, Crawford County,
Arkansas,to wit:
A tract of land being located in the Northwest Quarter(NW/4)of Section 19,
Township 9 North,Range 31 West,Crawford County,Arkansas.
See Exhibit A and Exhibit B attached hereto and hereby made a part of the instrument, with rights
of ingress and egress to and from the same,
To have and to hold said easement unto GRANTEES forever.
GRANTORS shall have the right to use the surface of the property above described as long as
GRANTORS wish, provided, that GRANTORS shall not interfere with the use thereof by
GRANTEES, and further, GRANTORS shall not erect a permanent building or other structure
within said Easement, and further, GRANTORS shall provide gates acceptable to GRANTEES if
said Easement is fenced.
After completion of construction or future maintenance, Grantees shall restore the land in this
permanent/temporary easement(whichever the case, or both)to as near its original condition as
possible,subject to both parties acting in a reasonable manner.
The consideration paid by 'GRANTEES is received and accepted by GRANTORS in full
satisfaction of every right hereby conveyed.
GRANTORS do hereby covenant with GRANTEES that GRANTORS are lawfully seized and
possessed of the real estate above described and that GRANTORS have a good and lawful right to
convey the same or any part thereof.
It is hereby understood that party securing this grant in behalf of GRANTEES is without authority
to make any covenant or agreement not herein expressed.

GAS UTILITY EASEMENT

EXHIBIT "A"
For the purpose of creating a Ten Foot(10') permanent easement over and
across a certain tract of land owned by the City of Van Buren. Said tract of land
being located in the Northwest Quarter(NW/4)of Section 19,Township 9 North,
Range 31 West, Crawford County,Arkansas.The centerline of said easement
being more particularly described as follows:
PERMANENT EASEMENT
A Ten Foot(10')wide easement being Five Foot(5')on each side of the
centerline, Commencing at the Southwest Corner(SW/C), Northwest Quarter
(NW/4), Northwest Quarter(NW/4) of said Section 19;Thence along the West
line of said Northwest Quarter(NW/4) of the Northwest Quarter(NW/4) North
02°54'43" East a distance of 232.63 feet;Thence leaving said West line North
83°27'37" East a distance of 20.28 feet to a point on the East approximate
right-of-way line of North 11th Street,the Point of Beginning;Thence North
83°27'37" East a distance of 141.54 feet;Thence along a curve to the left,with a
radius of 270.02 feet, a chord bearing of North 61°30'31"East and a chord
distance of 161.82 feet; Thence North 43°45'23"East a distance of 69.69 feet;
Thence along a curve to the right with a radius of 783.77 feet, a chord bearing of
North 43°48'37"East and a chord distance of 115.23 feet;Thence North
54°04'58" East a distance of 257.38 feet to the Point of Terminus.
Said permanent easement as described containing a total of 0.17 acres(45
