ORD NO 40-1995 j s CITY OF VAN BUREN, ARKANSAS ORDINANCE NO. 92-) -1995 AN ORDINANCE EXPANDING THE VAN BUREN MUNICIPAL COURT AND DUTIES OF THE CITY ATTORNEY, ESTABLISHING A NEW MUNICIPAL COURT POSITION, AND SETTING SALARIES. WHEREAS, It is the desire of the Van Buren City Council that in the future the Van Buren Municipal Court will become a full time position and that the position of Van Buren Municipal Judge will become a full time position; and WHEREAS, Due to the growth of the City of Van Buren and its Police Department and the increase in the number of City cases now being heard in the Van Buren Municipal Court., it is necessary to increase the number of court sessions in order to properly adjudicate the present and expected case load; and WHEREAS, In order to accommodate the increased City case load and .extra court sessions and in order to better position the City of Van Buren and its municipal court system for a future move to a full time court, it is necessary to expand the position of Van Buren City Attorney to a full time position, to create the position of Municipal Court Case Coordinator and to set the initial salary of the Case Coordinator and the salaries of the City Attorney and Municipal Judge: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS: SECTION 1: THAT, at this time, the position of Van Buren Municipal Judge shall remain a part time position, but in consideration of the increase of the number of Court Sessions necessary to accommo- date the City's increased case load, the initial annual salary of the Van Buren Municipal Court Judge shall be set at $37,500.00 representing the City's share of the total salary. SECTION 2: THAT the position of Van Buren City Attorney shall be a full time position and that the initial salary of Van Buren City Attorney shall be set at $40,000.00 The current City Attorney shall not be prohibited from con- tinuing to represent the cities of Alma and Mountain burg in their city courts, so long as the said city courts continue to be held after regular working hours. SECTION 3: THAT the position of Municipal Court Case Coordinator shall be established within the Van Buren Municipal Court, said position to initially be a permanent, part time position, to work a minimum of 30 hours per week, with the initial annual salary set at $10,250.00 which represents one -half of the total salary, the remainder to be paid by the Municipal Judge from the proceeds of his private practice. SECTION 4: THAT in consideration of the payment of that portion of the Case Coordinator's salary paid by the Municipal IP Judge and as part of the total compensation package afforded the Municipal Judge, the Municipal Judge shall be allowed to utilize an office in the Municipal Com- plex for the conduct of his private law practice until such time as the position of Municipal Judge shall become full time. SECTION 5: THAT THE Municipal Court Case Coordinator's position, the full time City Attorney's position, and the initial annual salaries for the Case Coordinator, City Attorney and Municipal Judge set out herein shall commence on January 1, 1996. SECTION 6: THAT the Municipal Court Case Coordinator, City Attorney and Municipal Judge shall not participate in the 5% cost of living raise if approved by the Van Buren City Council to be effective for the year 1996. SECTION 6: THAT the City Attorney fees collected by the Municipal Court shall be spent to pay the general expenses of the City.
