ORD NO 39-1995 CITY OF VAN BUREN, ARKANSAS 0 ORDINANCE NO. ,3 9 -1995 AN ORDINANCE SETTING REGULATIONS FOR STREET CUTS AND STANDARDS FOR THEIR REPAIR. WHEREAS, It is the desire of the Van Buren City Council to update and improve the City regulations regarding street cuts and their repair: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS: SECTION 1: It shall be unlawful for any person, public or private corporation, utility company, or contractor, to make or cause to be made any excavation in any street or alley of this City without first having obtained a written permit from the Van Buren Street Department. SECTION 2: A fee of 50.00 shall be paid before any permit shall be issued except that the fee may be waived for permits for work being accomplished by the Departments of the City of Van Buren or their agents or their contractors but the requirement of the securing of a permit shall not be waived. SECTION 3: All excavations crossing any street or alley of this City and the repairs thereto shall be accomplished in accordance with, and adhereing to, the plans, specifica- tions and instructions for street cuts and repairs set out in the attached drawings attached hereto and incorporated into this Ordinance as if set out word for word herein. Three (3) sets of the plans, specifications and instruct- ions shall be on file in the Van Buren City Clerk's Office. SECTION 4: All persons, public or private corporations, utility com- panites, and contractors shall be required to post a surety bond or provide evidence that such bond is in force to insure that the requirements of this Ordinance are met. The minimum surety bond shall be $500.00 and may be waived for work being accomplished by the Dep- artments of the City or their agents or their contractors. SECTION 5: If any person, public corporation, utility company or con- tractor does faulty work in the backfill and repair of the streets and alleys of this City or otherwise violates the provisions and requirements of this Ordinance, the City shall reserve the right to refuse to allow said person, public or private corporation, utility company or contractor to do any further work in the streets and alleys of the City. SECTION 6: In the event street cuts are not completed in accordance with the provisions and requirements of this Ordinance, the City, at its option, (after written notice and an opportunity to correct the deficiency is given) may cause the proper repairs to be made and shall bill the person, public or private corporation, utility company or contractor for the actual cost of the repairs. SECTION 7: The Van Buren Street Department shall be notified when permitted street repairs are completed so that an inspection may be scheduled. SECTION 8: Until such time as the street cut repair is accepted by the Van Buren Street Department, the person, public or private corporation, utility company or contractor res- ponsible shall maintain all necessary lights, barricades, or other devices to prevent accidents resulting from the street cut. SECTION 9: Violation of any of the provisions or regulations of this Ordinance shall be punishable as a misdemeanor with a fine of up to $250.00. Each day that said violation con- tinues shall be a separate offense and each day subsequent to the first day of the violation shall be punishable by a fine of up to $250.00 per day. SECTION 10: All prior Ordinances or parts of Ordinances in conflict herewith, specifically Ordinance No. 7 -1976 and Ordinance No. 3 -1980 are hereby repealed. The provisions of this Ordinance are hereby declared to be severable, and if any provisions shall for any reason be illegal or invalid, such holding shall not affect the validity of the remainder of this Ordinance. SECTION 11: This Ordinance being necessary for the immediate Protection of the public peace, health, welfare and safety of the citizens of Van Buren, Arkansas, an emergency is hereby declared to exist, and this Ordinance shall be in full force and effect from and after its passage.
