ORD NO 33-1995 CITY OF VAN BUREN, ARKANSAS ORDINANCE NO. -1995 AN ORDINANCE PROVIDING FOR THE VACATING AND ABANDONMENT OF STREET AND ALLEY RIGHTS -OF -WAY IN AND ADJACENT TO BLOCKS 10 THROUGH 15, 18 -19 AND 23 OF HYNES ADDITION TO THE CITY OF VAN BUREN, OF A PORTION OF ALLEY RIGHT -O -WAY IN BLOCK 82 OF THE ORIGINAL TOWN OF VAN BUREN AND OF A PORTION OF STREET RIGHT -OF -WAY KNOWN AS FIRST STREET OR FRONT STREET. WHEREAS, A Petition was filed with City Council of the City of Van Buren, Arkansas, asking the City Council to abandon certain described street and alley rights -of -way located in the City of Van Buren, Arkansas; and, WHEREAS, The Council did on the 30th day of October, 1995, pass a Resolution setting a date for hearing on the Petition and ordering the City Clerk to give notice of such hearing as required by Arkansas Statute; and, WHEREAS, After due notice as required by law, the Council has, at the time and place set out therein, heard all persons desiring to be heard on the question and has ascertained that the street and alley rights -of -way herein above designated have heretofore been dedicated to the public use as street and alley rights -of -way, that the subject street and alley rights -of -way have never been opened and used by the public, that the said street and alley rights -of -way are unnecessary and are not needed for the corporate purposes of the City of Van Buren, and that the public interest and welfare will not be adversely affected by the abandonment and vacation of the said street and alley rights -of -way. NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS: SECTION 1: Pursuant to the authority delegated to the City by A.C.A. 14 -54- 104(2) and otherwise, the City of Van Buren, Arkansas, hereby releases, vacates and abandons the hereinafter described street and alley rights -of -way dedicated by the plat of Hynes Addition to the City of Van Buren: a. Gresham Street west of Major Henry Street; b. Dribrell Street west of Major Henry Street; c. Brown Taylor Street west of Major Henry Street; d. Connor Street south of Laura Street; e. Phelps Street south of Laura Street; f. Morell (sometimes known as Knox) Street west of Major Henry Street; and, g. Alleys located in Blocks 10, 11, 14, 15, 18 and 23. SECTION 2: Pursuant to the authority delegated to the City by A.C.A. 14- 54- 104(2) and otherwise, the City of Van Buren, Arkansas, hereby releases, vacates and abandons the hereinafter described street and alley rights -of -way: a. That portion of the alley in Block 82 of the Original Town of Van Buren lying north of the railroad right of way; and, b. That portion of a street, sometime referred to as First StraxL or Front Street, lying east of Lots 4 -8 of Block 82, Original Town of Van Buren, and west of a tract sometimes known as Lot 1 of Block 24 of Scott's Greater Addition as shown by a map of the City of Van Buren, Arkansas, said tract being a part of the north half of the northwest quarter of Section 25, Township 9 North, Range 32 West, said street right -of -way being more particularly described as beginning at the eastern point of intersection of First (Front) Street and Morell (Knox) Street (the northwest corner of Lot 1 of Block 24 of Scott's Greater Addition); thence along the western edge of said tract known as Lot 1 to the southeast corner of said Lot 1 (said line being the western most edge of a tract of real property in said Section described as beginning at the point of intersection of First Street with Morell Street, thence along the south side of Morell (Knox) Street 172.5 feet;thence south 150 feet; thence west to First (Front) Street; thence along the northeast side of First (Front) Street to Morell (Knox) Street and the place of beginning); thence in a westerly direction to the southeast corner of Lot 4 in Block 82 of the Original Town of Van Buren; thence along the eastern edges of Lots 4 -8 of said Block 82 to the north eastern most point of said Lot 8; then along the southern edge of Morell (Knox) Street to the point of beginning. SECTION 3: The City Clerk shall cause a copy of this Ordinance to be provided to the Clerk and Ex- officio Recorder of Crawford County for the purpose of causing the vacation action of the City Council to be placed of record in the real property records of Crawford County. SECTION 4: Emergency Clause. It is hereby determined that the continued platting of unopen street and alley rights -of -way in the properties affected by this Ordinance continues to hinder the proper use and development of the subject properties so that the said street and alley rights -of -way not only are not needed for the corporate purposes for the City but are adversely affecting the public health, safety and welfare so that an emergency is determined and declared to the end of this Ordinance shall be in full force and effect from and after its passage.
