DRAINAGE AND UTILITY EASEMENT
KNOW ALL MEN BY THESE PRESENTS:
That JIM AND MARY HALE, GRANTORS, for and in consideration of the sum of $1.00 and
other good and valuable consideration paid by the CITY OF VAN BUREN, ARKANSAS, a
municipal corporation, hereinafter called GRANTEE, the receipt of which is hereby
acknowledged, do hereby grant, bargain, sell, and convey to said GRANTEE, its successors and
assigns a Permanent Drainage and Utility Easement for the construction, operation, and
maintenance a drainage system and for public utility lines and any appurtenances thereto, across,
under and upon the following described lands lying in the City of Van Buren, Crawford County,
Arkansas, to wit:
Part of Lot 1 and part of Lot 2, Pazadise Living, an addition to the City of Van Buren,
Crawford County, Arkansas, filed October 4, 2018, being more particularly described as
follows:
Beginning at an existing mag nail marking the Northwest corner of said Lot 1; thence S
88'01'28" E, along the north line of said Lot 1, 19.74 feet to a point; thence leaving the
north line of said Lot 1, S 47°02'24" E, 24.65 feet to a point; thence S 87°29'28" E, 206.89
feet to a point on the east line of said Lot 1; thence S 00°17'56" W, along the east line of
said Lot 1, 15.01 feet to a point; thence leaving the east line of said Lot 1, N 87°29'28" W,
165.50 feet to a point; thence S 04°41'43" W, 135.33 feet to a point; thence S 0291'08"

N 87029128" W, 27.48 feet to a point; thence N 47°02'24" W, 43.32 feet to a point on the
west line of said Lot 1; thence N 02°27'06" E, along the west line of said Lot 1, 2.70 feet
to the Point of Beginning, containing 0.433 acres or 18,847.3 square feet, more or less.
With rights of ingress and egress to and from the same.
In addition, GRANTEE, its successors and assigns shall have the temporary right to enter upon
and use as a Temporary Construction Easement, a ten (10) foot wide strip of land on both sides of
the above described permanent easement for the purpose of doing all acts necessary for
construction of a public drainage system. It is agreed that the GRANTEE will, after completion
of construction, restore the land in this temporary easement and the permanent easement to a

mutually acceptable condition, subject to both parties acting in a reasonable manner. This
temporary easement as conditioned above shall terminate when the construction project has been
completed and accepted by the GRANTEE.
The consideration paid by the GRANTEE is received and accepted by the GRANTORS in full
satisfaction of every right hereby conveyed.
GRANTORS do hereby covenant with GRANTEE that GRANTORS are lawfully seized and
possessed of the real estate above described and that GRANTORS have a good and lawful right to
convey the same or any part thereof.

thence N 86'13'10" W, along the north line of said Lot 2B, 485.49 feet to the Point of
Beginning; thence leaving the north line of said Lot 2B, S 02°27'34" E, 356.61 feet to a
point; thence S 74°06'51" W, 181.23 feet to a point on the south line of said Lot 2C; thence
N 86°13'20" W, along the south line of said Lot 2C, 148.59 feet to a point; thence leaving
