PC Minutes 11-05-2024City of Van Buren, Arkansas Planning Department 1003 Broadway •Van Buren, Arkansas 72956 PLANNING COMMISSION MINUTES November O55 2024 1. Call To OrderBoll Call. The Van Buren Planning Commission held its monthly meeting on Tuesday, November O5, 2024, at 5:30 P.M. The meeting was held at the Van Bwen Municipal Complex in the City Council Chambers. The following Commissioners were present: Chairman Mark Evans,. Vice -Chairman Philip Bagby, Jared Clark, Missy Hefner, Jason Myers, Mason Shirey, Jay White, and Nathan Wilson. Commissioner Tiffany Webster was absent. City Staff present were Planning Director Wally Bailey, City Inspector David Martin, Commission Secretary Jennifer Willoughby, and Steve Dufresne &Chris Coombes of VBMU. 2. Approval Of Minutes From October Ol, 2024. A motion to approve was made by Commissioner Jay White and seconded by Vice -Chairman Philip Bagby. The motion was approved unanimously. 3. Discussion: Requesting Amendment To Ord. No. 31-2028 Regarding Animals And Fowl Inside City Limits —Jim Jones; Amend To Prohibit Roosters In City Limits. Mr. Jim Jones explained to the Commission that he owns a duplex on Buena Vista Avenue and the tenants complain about the noise from the neighbor's roosters. Mr. Jones requested that the Commission consider changing the ordinance to prohibit roosters, not chickens, in the city limits. Mr. Bailey stated that the request is not an unusual restriction, that multiple neighboring towns prohibit roosters. Commissioner Jason Myers said he feels the Commission would be for prohibiting roosters and for looking into changing the wording in the ordinance. Vice -Chairman Philip Bagby mentioned the need to check with city attorney regarding any possible cultural issues. Mi•. Bailey will submit more information to the Commission at the next meeting. 4. Final Plat Review —Legacy Cottages Lot 1—WD Builders/Brixey )engineering. A motion to approve recommendation to City Council contingent of Brixey Engineering putting up a Bond for public improvements was made by Vice -Chairman Philip Bagby and seconded by Commissioner Mason Shirey. The motion was approved unanimously. Chad Brixey of Brixey Engineering was present at the meeting as well as neighboring property owners: Maurice, Dee, Clifford, and Cameron Hubbs. 1of2 Chad Brixey of Brixey Engineering has requested approval of the final plat subject to the submittal of financial assurance for public improvements as described in the Subdivision Regulations. The Preliminary Plat has been approved, the plans for the water line and drainage have been approved and estimates submitted for the work. Commissioner are Clarlc asked the Hubbs family if they would like to speak. Mr. Cliff Hubbs stated that his attorney and another engineering firm told him the detention pond won't hold, and that the flooding problem will continue. Vice-Chaiman Bagby asked Mr. Hubbs if he has any engineering data to submit that would back up the claims being made. Mr. Hubbs responded no he does not. Next, Mr. Cameron Hubbs stated that he still doesn't believe the commission approved the length of the private drive when they approved the preliminary plat in May 2023. Vice - Chairman Bagby, Mr. Bailey, and Mr. Brixey reiterated that the Hubbs `family concerns have been addressed. The developer corrected the drainage issues before the final plat could be considered and since no other engineering reports have been presented there is no basis for not considering and approving the final plat. 5. Old/New Business. 6. Adjourn. A motion to adjourn was made by Commissioner Jason Myers and seconded by Commissioner Nathan Wilson.
