DATE: NOVEMBER 25, 2024 CC: PURPOSE: The applicant wants to add a roof over the front porch. APPLICANT: Wayne and Melanie Carson ZONING: R-1 Family Residential District SETBACKS: Front Yard: 25 feet or 50 feet from C/L of street whichever is greater Side Yard: 7'/Z feet Rear yard: 20 feet from property line and at least 20 feet between buildings Side yard Next to the street: 15 feet from the street property line or 35 feet from C/L of street whichever is greater. LOT WIDTH: N/A LOT AREA: N/A VARIANCE REQUEST: The porch is proposed to encroach into the front yard setback by 9 feet. See the attached survey from Cornerstone Surveying. BOARD OF ZONING ADJUSTMENT POWERS: Article VIII, Section 5 (3) Zoning Ordinance: To hear and decide applications for variance from the terms of this Ordinance in cases where a specific place of property characterized by exceptional narrowness, shallowness or shape was a lot or record at the time of adoption of this Ordinance; or where by reason of exceptional topographic conditions or other extraordinary or exceptional situations or conditions of a piece of property; provided that such relief may be granted without substantial detriment to the public good and without substantially impairing the intent and purpose of this Ordinance as specifically authorized in Article VI, Sections 1 and 3. COMMENTS: The Vista Royale subdivision was platted with a 30' front yard setback which is why the setback request is 9 feet and not 4 feet. The proposed porch roof will not be an enclosed structure. Should the Board decide to approve the request then a condition should be attached with the variance that this is for a cover only and not for any portion to be enclosed.
