BE IT ENACTED BY THE CITY COUNCIL,FOR THE CITY OF VAN BUREN,
ARKANSAS,A RESOLUTION TO BE ENTITLED:
A RESOLUTION APPROVING AND ACCEPTING THE FINAL PLAT OF
"LEGACY COTTAGES LOT 1" WITHIN THE CITY OF VAN BUREN,
CRAWFORD COUNTY,ARKANSAS.
WHEREAS, the City of Van Buren, Arkansas, is duly incorporated under the laws of the State of
Arkansas,with all powers,authority,and duties of a city of the first class, and under such
authority has adopted the Subdivision Regulations for the City of Van Buren (Ordinance
No.7-2003);and
WHEREAS, A final plat recommended for approval by the Planning Commission shall be transmitted
to the City Council for action; and
WHEREAS, The City Council approval is required for its acceptance of the dedication of public streets,
easements,alleys,parks and/or other public space located within the city; and
WHEREAS, the Van Buren Planning Commission reviewed and approved this final plat on November
5,2024; and
WHEREAS, as a result of this meeting,the proposed Final Plat hereto was recommended by a majority
vote of the entire Planning Commission.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
VAN BUREN,CRAWFORD COUNTY,ARKANSAS.
SECTION 1: Subject to the assurances provided in the Code of General Orders of the City of Van Buren
Subdivision Regulations Title 15 et sq.,being executed to assure that all improvements are
put in and that all requirements of the Planning Commission are met,the submitted Final
Plat for LEGACY COTTAGES LOT 1 within the City of Van Buren, is hereby approved
and accepted.
SECTION 2: The Mayor is authorized and directed to sign said plat document and the City Clerk is
authorized and directed to attest to same upon acceptance by the City of the constructed
improvements or upon filing of any necessary bonds with the City Clerk.

VAN BUREN CITY COUNCIL MEMORANDUM
TO: MAYOR JOE HURST AND CITY COUNCIL

SUBJECT: FINAL PLAT FOR LEGACY COTTAGES LOT 1
DATE: NOVEMBER 21, 2024
The subject final plat was approved by the Planning Commission at their November 5, 2024,
regular meeting. The subdivision regulations state that "A final plat recommended for approval
by the Planning Commission shall be transmitted to the City Council for action. The City
Council approval is required for its acceptance of the dedication of public streets, easements,
alleys,parks, and/or other public space located within the City. "
The final plat includes the dedication of right of way for Oliver Springs Rd. The additional right
of way is necessary for the future widening of Oliver Springs Rd to arterial road standards. The
road is classified as an arterial on the Master Street Plan.
The final plat also includes the dedication of right of way for the future Legacy Blvd. The future
extension of Legacy Blvd is a Collector street on the Master Street Plan.
The history of the Planning Commission's review of the plat is as follows:
• The preliminary plat was reviewed on February 7, 2023, and denied pending
additional information that needed to be addressed.
• The preliminary plat and development plan were reviewed on May 2°d, 2023. The
Planning Commission approved the preliminary plat and development plan
contingent upon the existing drainage problems on the parent tract be corrected
before the final plat is reviewed. (The parent tract is property not included in this
plat but where grading work was done that had affected drainage in the area.)
• The developers engineer prepared a drainage report and plans to address the off-
site drainage problems. We had the drainage report and plans reviewed and
approved by our engineer,Neal Morrison, PE. The off-site drainage work was
completed and inspected and certified by the design engineer Chad Brixey, PE
and inspected by our street department director, John Karstens.
• At the October 1, 2024, meeting the Planning Commission met to review the off-
site drainage improvements and they approved the work as complete.
• At the November 5, 2024, meeting the Planning Commission approved the final
plat.
Upon approval of the final plat, the developer will submit bonds to ensure the construction of a
water line and drainage improvements. The City staff and Van Buren Municipal Utilities have
approved the engineer's plans and the bond amounts for the improvements. The final plat will
not be filed until all bonds have been submitted.
