ORD NO 15-1996 CITY OF VAN BUREN, ARKANSAS
ORDINANCE NO. S -1996
AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO CONTRACTS FOR
EMERGENCY SERVICES.
WHEREAS, On Sunday, April 21, 1996, a devastating tornado
struck the City of Van Buren, leaving massive
destruction and creating health and safety hazards
for the citizens of the City; and,
WHEREAS, Van Buren has been declared a national and state
disaster area; and,
WHEREAS, As a result of the tornado disaster there existed,
and continues to exist, emergency situations and
jobs for which the City must contract for the use of
equipment, manpower and other services; and,
WHEREAS, Due to the City's designation as a disaster area, the
requirement of competitive bidding is automatically
waived but Council approval is still required for
expenditures over $5,000.00; and,
WHEREAS, The City anticipates that its expenses in contracting
for such equipment, manpower and other services
will be reimbursed from FEMA funds.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF VAN BUREN, ARKANSAS:
SECTION 1: That the City Council hereby authorizes the Mayor
to enter into any contracts for whatever amounts,
the Mayor deems necessary in order to effectuate
the clean -up of the devastated area and to help
alleviate the health and safety hazards and
concerns which existed and currently exist; and
further hereby ratifies any such contracts which
have already been executed and become effective.
SECTION 2: That this Ordinance being necessary for the
immediate protection of the public health, safety,
and welfare of the citizens of Van Buren, Arkansas,
an emergency is hereby declared to exist, and this
Ordinance shall be in full force and effect from and
4111 after its passage.
