ORDINANCE NOA I -2024
BE IT ENACTED BY THE CITY COUNCIL,FOR THE CITY OF VAN BUREN,ARKANSAS
AN ORDINANCE TO BE ENTITLED:
AN ORDINANCE ALLOCATING AND APPROPRIATING
INSURANCE PROCEEDS FOR REPAIRS TO THE VAN BUREN
SENIOR CENTER AND THE VAN BUREN LIBRARY
BUILDING; AUTHORIZING THE MAYOR TO CONTRACT
FOR ROOF REPAIRS AND IMPROVEMENTS; WAIVING
BIDDING REQUIREMENTS; DECLARING AN EMERGENCY;
AND FOR OTHER PURPOSES.
WHEREAS, the Van Buren Senior Center and Library Building suffered roof damages from a
hailstorm,which now need immediate repairs;and
WHEREAS, the City of Van Buren has insurance proceeds, which will cover all of the repairs
necessary; and
WHEREAS, the City Council has determined, pursuant to A.C.A. § 14-58-303(b)(2)(B), that
exceptional circumstances exist which render the competitive bidding process impractical
and unfeasible.
NOW,THEREFORE,BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF
THE CITY OF VAN BUREN,ARKANSAS,THAT:
SECTION 1: The City of Van Buren, Arkansas, has an immediate need to repair storm damage to the
Senior Center for$45,428.42 and Van Buren Library for$45,198.71, from Elite Roofing,
for the total sum of$90,627.13.
SECTION 2: Pursuant to A.C.A. § 14-58-303(b)(2)(B),the City Council hereby waives the requirement
of competitive bidding and directs the Mayor to enter into contract described in"Exhibit
A"for the price set forth in Section 1 above.
SECTION 3: Due to the immediate need to best serve, protect, and preserve the public health, safety,
and welfare of the citizens of the City of Van Buren, an emergency is declared to exist
and this ordinance shall take effect from and after its passage and approval.
SECTION 4: The Mayor and City Clerk are hereby authorized by the City Council for the City of Van
Buren to execute all documents,contracts,and agreements necessary to effectuate this
Ordinance.
IN WITNESS WHEREOF,the City of Van Buren,Arkansas,by its City Council,did pass,
approve,and adopt,by a vote of -for and against,the foregoing Ordinance at its regular meeting
held on the 28`"day of October 2024.

The Customer Acknowledges:
1.The customer has read this contract,has received a copy of this agreement,and agrees that it is a legal and binding contract.No oral terms or
agreements supersede this written agreement.
2.Any surplus material shipped to the job site belongs to Elite Roofing.Customers will supply the electricity and accessways necessary to perform work.
3.The company will perform all work In a workman-like manner according to the local building code and manufacturer's specifications.
4a.Upon delivering the materials,the customer agrees to pay 50%of the contract and the balance when the work Is completed. ;
4b.Upon delivering materials to an insurance job,the first check Is required,and the second check is due when recovered from insurance if not prior to the i
completion of services.
5a. The customer hereby understands and acknowledges that additional damage and/or repairs maybe made during the Inspections process and/or the
construction process after the initial/original contract is signed by the customer.If additional damage is found an/ar additional repairs are made during
the inspection processor during the construction process(this includes anything discovered by Elite Roofing's Insurance Specialist and/or the customer's
Insurance company)the customer hereby understands and acknowledges that additional fees/charges will he added In addition to the initial/original
contract price and will be paid to Elite Roofing by the customer or insurance company in the form of a supplement.—initial
5b.The customer hereby understands and acknowledges that pricing increases for materials and/or supplies purchased by Elite Roofing for this particular
job may occur after the initial/original contract is signed by the customer.Any such pricing increases will be determined by Elite Roofing's Insurance
Specialist and/or the customer's insurance company.If any pricing increases do occur after the initial/original contract Is signed by the customer,the
customer understands and acknowledges that additional fees/charges will be added to the to the initial/original contract price and shall be paid to Elite
Roofing by the customer or the customer's insurance company in the form of a supplement.Initial
6.Unless otherwise stated,no provision has been made to replace rotten or deteriorated decking.If such a condition arises there will be an additional
charge of$75 per 48 sheet.
7.The customer agrees that new shingles will take the shape of the existing decking structure,which may or may not be even.
8.Driveway waiver:customer agrees to allow the use of the driveway for product delivery and disposal and agrees to hold the company and material
suppliers harmless for any damage to the surface areas. I
9.The company is not responsible for repairing/replace any other items other than those listed above in the scope of work. j
10.The customer may cancel with Elite Roofing if done so IN WRITING within 3 days of contract.If canceled,the customer agrees to pay any restocking
fees that may be Incurred.
11.The customer agrees the company is not responsible for Interior damage if Incurred during the standard construction process.The customer is
advised to move objects away from walls and remove wall-hanging Items to avoid falling.
12.Roofing scheduling and completion contingent on weather.
Satellite System Disclosure
If you have a satellite system installed,we will remount it to your roof upon your request.However,you may need to contact your service provider to I
calibrate the satellite which may result In additional charges.It is hest to consult with your insurance to discuss if these fees are covered in your policy.
Electrical,Hvao,Refrigeration,Plumbing,etc line...Disclosure
Elite Roofing will in no way be responsible for any damage that occurs frorn Fasteners protruding through the roof deck and damaging in any way a line
that is run against said roof deck or a rafter.Your Elite roofing representative can inspect your attic to avoid this situation but said inspection still does not
deem elite roofing responsible for any damage described in this fashion
