JULY 2024 REGULAR MEETING City of Van Buren, Arkansas Minutes of the Regular Meeting of the City Council Monday, July 22, 2024 Van Buren Municipal Complex CALL TO ORDER 5:30M The regular meeting of the Van Buren City Council was called to order by Mayor Joseph P. Hurst at 5:30PM. City Attorney and Reverend Jacob Howell led the invocation. The Pledge of Allegiance was led by Mayor Joseph P. Hurst. ROLL CALL 5:31PM Present: Council Member Shannon Newerth-Henson, Council Member Tyler Wood, Council Member Tonia Fry, Mayor Joseph P. Hurst, City Attorney Jacob Howell, City Clerk-Treasurer Shawnna Reynolds Absent: Council Member Madison Simmons PRESENTATIONS -AWARDS Chief of Police Jamie Hammond's retirement as of July 31, 2024. CONSENT AGENDA 5:35PM After determining there were no reported objections or unfinished business, Council Member Mike Kneeland moved to approve the consent agenda which consisted of: o Minutes from June 24, 2024, City Council Meeting o Van Buren Municipal Utilities Resolution—Water Commission Appointment o Resolution 07-01-2024 Authorize to Pay Annual Support E911 o Resolution 07-02-2024 Historic District Guidelines o Financial Statements o Department Reports Motion was seconded by Council Member Matt Dodson. All in favor. None opposed. Consent Agenda approved. Mayor Hurst declared the consent agenda passed. NEW BUSINESS 5:36PM Resolution 07-03-2024 Chief Hammond Retirement City Clerk-Treasurer Shawnna Reynolds read the resolution in its entirety. Mayor Joe Hurst and the City Council honored the retiring Chief of Police Jamie Hammond. Chief Hammond was commended for his seven years of service to the City of Van Buren,for a total of 31 years, 11 months and 13 days in law enforcement. He was awarded his service side arm via Resolution 07-03-2024. It was a Glock G43, Generation 5, 9mm Caliber pistol, serial number ADTS809. Motion to adopt Resolution 07-03-2024 was made by Council Member Tonia Fry. Seconded by Council Member Matt Dodson. Roll Call. All in favor. None opposed. Resolution 07-03-2024 Chief Hammond Retirement is adopted with five yeas and zero nays. Resolution 07-04-2024 Authorize Entering into Contract with MAHG City Clerk-Treasurer Shawnna Reynolds read the resolution in its entirety. Mayor Joe Hurst made mention that this was a resolution to enter into a contract to update the Parks and Recreation Master Plan. This will cover professional services for the development of plans and designs. The cost will be$53,780. Mayor Hurst stated he is looking forward to this project. Motion to adopt Resolution 07-04-2024 was made by Council Member Tyler Wood. Seconded by Council Member Matt Dodson. Roll Call. All in favor. None opposed. Resolution 07-04-2024 Authorize Entering into Contract with MAHG is adopted with five yeas and zero nays. Y Resolution 07-05-2024 Amending Resolution 10-02-2022 Hawkins-Wier Downtown Drainage City Clerk-Treasurer Shawnna Reynolds read the resolution in its entirety. Mayor Joe Hurst introduced Kyle Salzer with Hawkins-Weir to discuss with the City Council the reason for amending Resolution 10-02-2022. Amendment No 1 has been submitted for a total amount of $138,970 for Downtown Van Buren Drainage Improvements Grant Project. Mr. Salzer stated he will now advertise bids,get all inspections and manage the day-to-day tasks for the TAP Grant. Motion to adopt Resolution 07-05-2024 was made by Council Member Tonia Fry. Resolution 07-05-2024 Amending Resolution 10-02-2022 Hawkins-Wier Downtown Drainage is adopted with five yeas and zero nays. Mayor Hurst declared the resolution passed and signed same in open council, duly attested by City Clerk-Treasurer Reynolds. Ordinance 15-2024 Amending Drainage Standard—Wally Bailey City Clerk-Treasurer Shawnna Reynolds read the ordinance in its entirety. Council Member Tyler Wood moved that the rules be suspended, and the ordinance be placed on its second reading. The motion was seconded by Council Member Mike Kneeland,followed by a unanimous vote by the council. The Clerk read the ordinance the second time by title only. Council Member Mike Kneeland moved that the rules be further suspended, and the ordinance placed on the third and final reading. The motion was seconded by Council Member Matt Dodson,followed by a unanimous vote by the council. The clerk then read the ordinance for the third and final time by title only. Planning Director Wally Bailey stated that the reason the Drainage Standards were being amended is because one word was missing. Item 2.5.A"storm water discharge volume is being changed to rate instead of volume. He stated the Planning Commission met on June 16, 2024, and approved this change. This will be applicable to new construction or any property greater than one acre. Motion to adopt Ordinance 15-2024 was made by Council Member Tyler Wood. Seconded by Council Member Mike Kneeland. Roll Call. All in favor. None opposed. Ordinance 15-2024 Amending Drainage Standard is adopted with five yeas and zero nays. Mayor Hurst declared the ordinance passed and signed same in open council, duly attested by City Clerk-Treasurer Reynolds. a- Ordinance 16-2024 Residential Sanitation Collection Agreement VBMU City Clerk-Treasurer Shawnna Reynolds read the ordinance in its entirety. The motion was seconded by Council Member Matt Dodson,followed by a unanimous vote by the council. The Clerk read the ordinance the second time by title only. Van Buren Municipal Utilities Director Steve Dufresne stated that the Water Commission advertised for bids for project to begin January 1, 2025, and Cards Recycling was the lowest bid and has been accepted. There will be an increase of about$1.80 per customer for recycling services. This will be a six-year contract. The new automated cart system will roll out in January 2025 and bags will no longer be put on the curb. He expects the recycling rate to increase by 4%. This should be a good move forward for the City of Van Buren and will be on par with the City of Fayetteville program. Motion to adopt Ordinance 16-2024 was made by Council Member Tyler Wood. Ordinance 17-2024 Approve Purchase of New Vehicle—Fire Department City Clerk-Treasurer Shawnna Reynolds read the ordinance in its entirety. Council Member Tonia Fry moved that the rules be suspended,and the ordinance be placed on its second reading. The motion was seconded by Council Member Shannon Newerth-Henson,followed by a unanimous vote by the council. The Clerk read the ordinance the second time by title only. Fire Chief Tim Arnold mentioned that there is a Fire Department vehicle ready for purchase from Breeden Dodge,with the City Council approval. It is a Dodge Ram 1500 Classic for the purchase price of$45,826.00. Motion to adopt Ordinance 17-2024 was made by Council Member Tonia Fry. Seconded by Council Member Shannon Newerth-Henson. Motion to approve the emergency clause made by Council Member Tyler Wood,seconded by Council Member Tonia Fry. Roll Call. All in favor. None opposed. The Emergency Clause passed with a vote of five yeas and zero nays. Mayor Hurst declared the emergency clause passed. MISCELLANOUS and GENERAL DISCUSSION 6:08PM Connie Martin from Almost Home Shelter made their quarterly report and handed out information regarding the dogs at the shelter. She mentions various chipping clinics and fund raisers in addition to the number of heart worm preventative measures, adoptions and animals that have had to be shipped out of state. There was discussion regarding the fostering of animals and the need for volunteers to do such. There was no further miscellaneous and general discussion.
