Single Family Current Zoning Residential - 1 Adjacent Zoning and Lund Uses: Residential -1; Single family residences Master Land Use Plan The 2009 Master Land Use Plan shows this property within an area classified as Residential, Master Street Plan. Amble On Lane is a local road. Flood Plain. No Public Improvements. N/A Purpose and Intent of Conditional Uses [Article VI, Section 4 (a)J: Certain uses are considered as conditional because of the potential harmful effects the use can cause to nearby property and because the requirements needed to eliminate those harmful effects vary fiom site to site. Thus, the Planning Commission, in considering each conditional use request, will review the overall compatibility of the planned use with surrounding property as well as such specific items as screening, parking, and landscaping to make sure that no harmful effects occur to nearby property. (4) The entrances and exits, internal street system, off-street parking, loading facilities and pedestrian walks are adequate for the purpose proposed. (5) Nearby property shall be protected from excess fumes, lighting, noise, glare, dust, and odor. (6) Necessary landscaping and screening required to meet the intent of this ordinance shall be provided. (7) Open space shall be maintained by the owner. (8) Signage will not be obtrusive or distracting so as to distract from the character of the neighborhood or be a nuisance to those living or working therein. STAFF COMMENTS$ The Permitted and Conditional Use Legend of the Zoning Ordinance indicates that dayeares are conditional use in ResidentiaM zoning districts. The Planning Commission should inquire about the pickup and drop off schedules to insure there will be no traffic congestion on the street at those times. The Planning Commission approved an in -home daycare for Ms. Shultz at this address at the May 2, 2023, meeting. Subsequently Ms. Shultz is now requesting approval of a new application that will allow up to fourteen (14) children. The application indicates there will be two employees (one being Ms. Shultz). Also, she indicates she will require parking in the driveway only and describes the pick-up drop off staggering to prevent traffic congestion. An approval of this conditional use should include all the details of Ms. Shultz' application as a condition of the approval.
