Currently vacant. Current Zoning Commercial-2 Adjacent Zoning and Land Uses: Commercial-2 and G (Future Casey's, O'Reilly's, Bank, Office, and Dollar Store) Master Land Use Plan The 2009 Master Land Use Plan shows this property within an area classified as Commercial. Master Street Plan. Alma Highway is classified as an Arterial Road; Alma Blvd is classified as a Collector and North 28th is classified as a Collector. Flood Plain. No Public Improvements. N/A Purpose and Intent of Conditional Uses [Article VI, Section 4 (a)J: Certain uses are considered as conditional because of the potential harmful effects the use can cause to nearby property and because the requirements needed to eliminate those harmful effects vary from site to site. Thus, the Planning Commission, in considering each conditional use request, will review the overall compatibility of the planned use with surrounding property as well as such specific items as screening, parking and landscaping to make sure that no harmful effects occur to nearby property. Development Standards and Review Guidelines. [Article VI, Section 4, (e)J The following development standards and design specifications shall be the basis for approval of a conditional use: (1) The design, location and operating plans shall be such that the safety of the public is protected. (2) The proposed land use will not adversely affect nearby property. (3) The size and shape of the site and the size, shape and arrangement of structures meet the minimum requirements of this ordinance. (4) The entrances and exits, internal street system, off-street parking, loading facilities and pedestrian walks are adequate for the purpose proposed. (5) Nearby property shall be protected from excess fumes, lighting, noise, glare, dust and odor. (6) Necessary landscaping and screening required to meet the intent of this ordinance shall be provided. (7) Open space shall be maintained by the owner. (8) Signage will not be obtrusive or distracting so as to distract from the character of the neighborhood or be a nuisance to those living or working therein. STAFF COMMENTS: The Permitted and Conditional Land Use Legend indicates that Indoor Firing Range is a Conditional Use in the Commercial-2 zoning district. Ms. Tedder is proposing an indoor firing range at this property and 6 leasable retail units. Van Buren Ordinance No. 26-2005 as amended by Ordinance No. 6-2015 includes specific details regarding the design and operation of an indoor firing range. In accordance with the Ordinance requirements, the Tedder's have provided fingerprint cards to the Arkansas State Police, they have submitted a criminal history report from the Arkansas State Police that indicates no criminal history for either of them. They have provided the statement that they will comply with all local, state, and federal laws, regulations and guidelines. The Tedders have employed Mark Evans as their architect for the project. Mark should help answer any questions related to the building design. WHEREAS, Ordinance No. 26-2005 adds indoor firing ranges as a conditional use to certain zones inside the City of Van Buren; and WHEREAS, certain amendments shall be made to the existing code in order to ensure that adequate safety measures are employed to protect the public; and WHEREAS, notice of a Public Hearing was duly published, and a Public Hearing was conducted by the Van Buren Planning Commission to consider these amendments; and V�I�REAS, the proposed amendments herein were recommended by a unanimous vote of the entire Planning Commission. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS, THAT: SECTION l : The Van Buren indoor firing range code established by Ordinance No. 26-2005 is hereby amended to read as follows: 7.48.03 Indoor firing ranges. All conditional use permits issued for an indoor firing range shall be subject to the following conditions: A. Sound level measurements shall be made ten (10) feet from outside the exterior wall of the building with a calibrated sound level meter Type II or better using the A -weighted scale it conformance with the existing standards promul aged by the American National Standards Institution. A: B. The noise level from outside the exterior wall of a firing range shall not exceed eighty (80) decibels. The Building Inspector or his/her designated representative shall inspect and review the operation of the facility six (6) months after the facility opens for business. Any cost for the inspection shall be borne by the owner/operator of the range. The purpose of the inspection shall be to ensure that no additional sound proofing measures are necessary.
