We are requesting a Variance.
We are requesting a variance from the requirement for 20400t street -side setback.
Request: To have street -side setbacks at 12.9 feet.
The variance requested is due to the rezone approved 6/6/23 as Rezone #5-2023. When
the property was re -zoned to C2, the setbacks changed causing the existing building to be
over setback lines.

VARIANCE REQUEST:
The addition is proposed to encroach into the street -side setback by 7.1 feet (from 20 feet to 12.9
feet) from the South 13�h Street right of way. The addition will match the building line of the
existing building.
BOARD OF ZONING ADJUSTMENT POWERS:
Article VIII Section 5 (3 Zoning Ordinance: To hear and decide applications for variance from
the terms of this Ordinance in cases where a specific place of property characterized by
exceptional narrowness, shallowness or shape was a lot or record at the time of adoption of this
Ordinance; or where by reason of exceptional topographic conditions or other extraordinary or
exceptional situations or conditions of a piece of property; provided that such relief may be
granted without substantial detriment to the public good and without substantially impairing the
intent and purpose of this Ordinance as specifically authorized in Article VI, Sections I and 3.
COMMENTS:
The proposed addition will match the existing building line along South 13a' Street. The Board of
Adjustment should make sure of the following:
The proposed addition and site development will allow adequate parking on the site for
employees and any customer parking.
Loading and unloading facilities shall be provided so as not to block any public way.
Outdoor storage and open display of items shall comply with the requirements of the
Zoning Ordinance. (A copy of the regulations are attached.)

Loading and unloading facilities shall be provided so as not to block any public way.

7. Salvage items and open display.
a. No permanent open display will be permitted on sidewalks or public right of
way.
bI There shall be no open display of any salvage items in the first twenty (20) feet
of any street right of way.
c. No required parking lot area shall be used for storage or display of salvage
items.
d. Outdoor storage shall be maintained in a manner that does not collect trash,
debris, and vermin.
e. Outdoor storage shall be arranged so that it allows for fire department access
to the premises. All outdoor storage shall be approved by the Fire Official.
f. All approved outdoor storage of salvage items shall be screened by a
permanent opaque screening fence or wall constructed of standard fencing
materials so that it cannot be seen from an adjoining property or street right of
way.
SECTION 6. I-1 Light Industrial District
1. Permitted Uses
a. The manufacturing, compounding, processing, packaging or assembling of those
products that will require the smaller sized, cleaner and more quite industries and will
involve a minimum of noise, dust, odor, or vibrations.
