BE IT ENACTED BY THE CITY COUNCIL,FOR THE CITY OF VAN BUREN,
ARKANSAS AN ORDINANCE TO BE ENTITLED:
AN ORDINANCE TO AMEND ORDINANCE NO. 7-1963
(VAN BUREN MUNICIPAL CODE NO.14.04.01) FOR THE
PURPOSE OF REZONING CERTAIN PROPERTY IN THE
CITY OF VAN BUREN, ARKANSAS, AMENDING THE
ZONING MAP OF THE CITY OF VAN BUREN,ARKANSAS,
AND FOR OTHER PURPOSES.
WHEREAS, the City of Van Buren,Arkansas,is duly incorporated under the law of the State
of Arkansas,with all powers,authority,and duties of a city of the first class; and
WHEREAS, the City of Van Buren has adopted the Zoning Ordinance for the City of Van
Buren(Ordinance No. 7-1963); and
WHEREAS, a request has been made by Julie Jett to rezone certain property within the city
limits of the City of Van Buren; and
WHEREAS, notice of a Public Hearing was duly published in the Southwest Times Record on
March 17,2024, and a public hearing was conducted as required by law(A.C.A
14-56-422)on April 2,2024; and
WHEREAS, as a result of this hearing,the Planning Commission recommended that certain
property within the city limits of the City of Van Buren be rezoned from its
previous classification to the following:
Current Zoning New Zoning
Commercial-2 R-3
Thoroughfare Commercial District Family Residential District

Planning Commission, in accordance with A.C.A. 14-56-422.
NOW,THEREFORE,BE IT ORDAINED AND ENACTED BY THE CITY
COUNCIL OF THE CITY OF VAN BUREN,ARKANSAS,THAT:
SECTION 1: The above-described property is hereby rezoned from C-2 to R-3 and the Van
Buren Zoning Map is hereby amended to reflect this rezoning.
IN WITNESS WHEREOF,the City of Van Buren,Arkansas,by its City Council, did
pass, approve, and adopt,by a vote of 1' for and D against,the foregoing Ordinance at its
regular meeting held on the 22"d day of April 2024.

Julie Jett has made an application to request a zoning change on the subject property from C-2 to
R-3.The purpose of the rezoning is to have the existing zoning snatch the residential land use of
the property and to make residential improvements to the property that will match the R 3 zoning
district.
Ms. Jett provided information that shows this property has been developed as a residential
structure since 1902 when it was built. The property was zoned C-2 when zoning was first
established in Van Buren and the C-2 zoning corridor was established on both sides of Broadway
street.
The surrounding properties include a commercial building and residential structures.The
proposed zoning is consistent with the zoning of the adjacent residential properties.
The Planning Commission recommended the rezoning and the zoning map amendment to the
City Council for approval.

I,Julie S.Jett (Copple), am requesting the rezone of my property at 11 South 15th
Street,Van Buren,AR 72956. It is currently zoned C-2 (Commercial) and would like
to rezone to R 3 (Multi-F'amily).
The house is a one-story 1902 square feet frame structure,with a 600 square foot
frame structure detached shop.When I purchased this property in 2022,my plans
were to make this shop into a business, so the zoning of commercial was fine.Since
that time,my mother has lost her husband to a nursing home and is now living alone
in a big house. She is 91 years old, and I would like-to have her close to me but living
on her own.
I have included the plans for this remodel with the application. I am requesting a
rezone so I can remodel the shop into an apartment for my mother.

This rezoning request is like some previous rezonings of existing residential properties that are in the
C-2 strip that is parallel with Main Street(Htvy 64).Ms.Jett wants to keep the property as a single-
family house and wants the zoning to match the land use of the property. She also wants to convert
the detached building to an apartment for her mother.The R-3 zoning is necessary to have the two
residences on the same property. The property is next to existing properties that are zoned R-3.
This property has been single family/residential use since 1902 so the zoning matches the long-
standing use of the property.I recommend this rezoning be approved.
