BE IT ENACTED BY THE CITY COUNCIL,FOR THE CITY OF VAN BUREN,ARKANSAS
AN ORDINANCE TO BE ENTITLED:
AN ORDINANCE AMENDING ORDINANCE 18-2022 TO WAIVE
COMPETITIVE BIDDING AND AUTHORIZE THE PURCHASE
OF A STREET DEPARTMENT VEHICLE FROM BRUCKNER'S
TRUCK AND EQUIPMENT OF VAN BUREN; FOR THE
APPROPRIATION OF FUNDS;AND FOR OTHER PURPOSES.
WHEREAS, the City Council approved the purchase of a street department vehicle from Bruckner's
Truck and Equipment on April 25,2022,for the price of$140,313.00;and
WHEREAS, after a lengthy delay in manufacturing, one of the subcontractors (Davis) for Bruckner's
Truck and Equipment closed. Due to this company's closure,the original purchase price
has increased from $140,313.00 to $157,672.19 from Bruckner's Truck and Equipment
of Van Buren.
NOW,THEREFORE,BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF
THE CITY OF VAN BUREN,ARKANSAS,THAT:
SECTION l: The City of Van Buren has a need to purchase a vehicle; 2025 Hino Twin Dump Truck,
from Bruckner's Truck and Equipment of Van Buren, for the price of$157,672.19 as
detailed in the attached quote(Attachment"A").
SECTION 2: The City Council in accordance with the terms of A.C.A. § 14-58-303(b)(2)(B) hereby
waives the requirement of competitive bidding and directs the Mayor and City
Clerk/Treasurer to purchase the above-described vehicle for the price set forth in
(Attachment"A").
SECTION 3: The Mayor and City Clerk/Treasurer are hereby authorized by the City Council for the
City of Van Buren to execute all documents, contracts, and agreements necessary to
effectuate this Ordinance.
IN WITNESS WHEREOF,the City of Van Buren,Arkansas,by its City Council, did pass,
approve, and adopt,by a vote of (p for and against,the foregoing Ordinance at its regular meeting

AN ORDINANCE TO BE ENTITLED:

WHEREAS, the City of Van Buren has determined that the street department is in need of replacing a
vehicle,and is not cost effective to perform the duties required for maintaining the streets

WHEREAS, after extensive research and inquiry, the City of Van Buren Street Department Manager
has determined that the purchase of a new vehicle from Bruckner's Truck and Equipment
of Fort Smith would be the most practical, feasible, and cost-effective method for the
department:and
NOW,THEREFORE,BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF
THE CITY Or, VAN BUREN,ARKANSAS,THAT:
SECTION 1: The City of Van Buren has a need to purchase a vehicle; 2023 Hino Twin Screw Dump
Truck, Brucknef's Truck and Equipment of Fort Smith, for the price of$140,313.00 as
detailed in the attached quote(Attachment"A").
SECTION 2: The City Council in accordance with the terms of A.C.A. § 14-58-303(b)(2)(B) hereby
waives the requirement of competitive bidding and directs the Mayor and City
Clerk/Treasurer to purchase the above-described vehicle for the price set forth in
