DRAIN AGE EASEMENT
KNOW ALL MEN BY THESE PRESENTS:
That Michael Balazic GRANTORS, for
and in consideration of the sum of SL00 and other good and valuable considerations, To,,;
them in hand paid by the CITY OF VAN BUREN, ARKANSAS, a municipal w
corporation, hereinafter called GRANTEE, the receipt of all .of which is _hereby
acknowledged, do hereby grant, bargain, sell and convey, unto the said GRANTEE, its
successors and assigns a Permanent Easement and Right -of Way for the construction,
operation, and maintenance of a public, drainage facilities, both above ground and
underground, over, across, under and upon the following described lands lying in the City
of Van Buren, Crawford County, Arkansas, to wit;
A part of Lot 47 of Oliver Springs Heights, as filed for reoord September 1,
1998, Van Buren, Crawford County, Arkansas, being more particularly
described as follows:
Commencing at the southeast comer of said Lot 47, thence N 86�59'06" W,
40.00 feet along the south line of said Lot 47 to the POINT OF BEGINNING,
said point being on the west line of an existing 40400t Drainage and Utility
Easement, thence N 86°59'06" W, 30.00 feet along the south line of said Lot 47,
thence N 2°53'57" E, 85.00 feet parallel to the east line of said Lot 47; thence S
86059706" E, 30.00 feet to said west line of an existing 40-foot Drainage and
Utility Easement; thence S 2°53'57" W, 95.00 feet to the POINT OF
BEGINNING, containing 2,550 square feet more or less.
with right of ingress and egress to and from the same.
TO 1jAVE AND TO HOLD said Easement unto said GRANTEE, its successors and
assigns forever.
For the purpose of construction, it is agreed that the GRANTEE, its agents and assigns
shall have the temporary right, until completion and acceptance by the GRANTEE of the
work, to enter upon and use an additional 20 feet on the west and north sides of the
Permanent Easement herein granted, containing 2,701 square feet, more or less.
It is agreed that the GRANTEE will, after completion of construction, restore the land
and improvements within the Temporary Easement to a mutually acceptable condition,
subject to both parties acting in a reasonable manner. The Temporary Easement as
conditioned above shall terminate when the improvement construction has been
completed and accepted by the GRANTEE,
The consideration paid by the GRANTEE is received and accepted by the GRANTORS
in full satisfaction of every right hereby conveyed.
