G'S�= � f�ey� ,--I/��G'�' /Gc����o� ,GRANTORS, - �for� and in consideration of the sum of $1.00 and other good and valuable con�derations, to them in hand paid by the CITY OF VAN BUREN, ARKANSAS, a municipal corporation, hereinafter called GRANTEE, the receipt of all of which is hereby acknowledged, do hereby grant, bargain, sell and convey, unto the said GRANTEE, its successors and assigns a Permanent Easement and Right -of --Way for the construction, operation, and maintenance of public, drainage facilities, both above ground and underground, over, across, under and upon the following described lands lying in Crawford County, Arkansas, to wit; Part of the Northeast Quarter (NE '/4) of the Northwest Quarter (NW '/4) of Section 18, Township 9 North, Range 31 West of the fifth Principal Meridian, Crawford County, Arkansas. More particularly described as follows: Commencing at the Northwest corner of said NE '/< of the NW '/4, thence S 0°23'40" E, 168.32 feet to the Northwest corner of parcel described in Warranty Deed 2000-027483 and the POINT OF BEGINNING; thence S 59°13'S1" E along the north line of said parcel in Deed 2000-027483 for 136.47 feet; thence, leaving said north line, S 30°46'09" W, 15.00 feet; thence N 59°13'S1" W, 90.66 feet; thence S 43°31'45" W, 45.32 feet to the west line of said parcel in Deed 2000-027483; thence N 0°23'40" W, 69.18 feet to the POINT OF BEGINNING, containing 2,791 square feet, more or less. with right of ingress and egress to and from the same. TO HAVE AND TO HOLD said Easement unto said GRANTEE, its successors and assigns forever. For the purpose of construction, it is agreed that the GRANTEE, its agents and assigns shall have the temporary right, until completion and acceptance by the GRANTEE of the work, to enter upon and use an additional 10 feet on the south side of the Permanent Easement herein granted, containing 1,332 square feet, more or less. It is agreed that the GRANTEE will, after completion of construction, restore the land and improvements within the Temporary Easement to a mutually acceptable condition, subject to both parties acting in a reasonable manner. The Temporary Easement as conditioned above shall terminate when the improvement construction has been completed and accepted by the GRANTEE.
