13 PLANNING (2) S-22 TITLE 13 PLANNING Chapter: 13.04 Planning Commission 13.08 Land Use Plan 13.12 Metropolitan Planning Organization CHAPTER 13.04 PLANNING COMMISSION Sections: 13.04.01 Commission created 13.04.02 Terms of members 13.04.03 Election of officers;rules 13.04.04 Employment of assistance, expenditures 13.04.05 Powers and duties 13.04.06 Planning area map 13.04.07 Amendments to Subdivision Ordinance 13.04.01 Commission created There is hereby created a City Planning Commission to consist of nine (9)members, at least two-thirds (2/3) of said Commission shall not hold any other elective or appointive municipal office. The members of the Commission shall be nominated by the Mayor and confirmed by the City Council. 13.04.02 Terms of members The members of said Planning Commission shall be appointed to a term of three (3)years. When the term of any member shall expire the Mayor shall make a nomination to fill such vacancy for a period of three(3)years. When a vacancy shall otherwise occur,the Mayor shall nominate a person to serve the remainder of the term. 13.04.03 Election of officers,rules At a time and place to be designated by the Mayor, the Planning Commission shall meet and organize by electing from its members a chairman, a vice-chairman, and a secretary. The Planning Commission shall make and adopt such rules and regulations to govern its proceedings,which shall provide for a regular meeting date at least once each three(3)months and more often if prescribed by the Commission. Q198 S-25 13.04.04 Employment of assistance; expenditures The Planning Commission is authorized to employ such assistance as is deemed necessary in carrying out its duties and responsibilities. It cannot expend or encumber city funds without prior appropriation by the City Council 13.04.05 Powers and duties The Commission is vested with all the powers and duties prescribed and set forth in A.C.A. 14-56-402— 14-56-409. 13.04.06 Planning area map A. The planning area boundaries for the city of Van Buren,Arkansas, shall be a one mile perimeter of said city limits, as set out in the Planning Area Map attached hereto and incorporated herein by reference, and more particularly described in the legal description attached hereto. A copy of said map shall be kept on file at the office of the Van Buren City Clerk and the County Recorder. B. If it should be determined that there is a discrepancy between said reap and the one mile perimeter,the map shall be the final authority of the location of the planning area boundary. C. The city of Van Buren hereby adopts all state laws.and regulations concerning the enforcement of activities within its planning area boundaries. (Ord.No. 15-2013, Secs. 1-3 J 13.04.07 Amendments to Subdivision Ordinance Article II, Section A-1 The Subdivider shall submit to the Planning Commission twenty (20) copies of a preliminary plat,together with the pertinent supporting data, at least twenty (20) days prior to the meeting of the Planning Commission at which consideration is requested. A subcommittee of the Planning Commission will.review the preliminary plat at least sever(7) days prior to the Planning Conunission meeting, and make recommendations to the Planning commission on the availability of utility easements, and street right-of-way to serve the properly under consideration. (Ord.No. 2-2000, Sec. 1.) Article H, Section B-2 Twenty(20) copies of the final plat shall be submitted to the Planning Commission for review. The final plat shall be drawn at a scale of 1" = 100' or larger, and shall be on a sheet size of 18"x 24", 14" x 36", 30" x 42" or 22" x 34". (Ord.No. 2-2000, Sec. 2.) Article H, Section B-7 Pursuant to Section 5-C,Arkansas Planning Law Act 186-1957; The County Recorder shall not accept any plat for record without the approval of the Planning Commission. Following approval of the Planning Commission and acceptance by the City Council,if the properly is located within the city or within the five mile jurisdiction,fifteen(15) copies of the Final Plat shall be filed with the County Recorder. (Ord.No. 2-2000, Sec. 3.) ;r-� 199 S-22 O CHAPTER 13.08 LAND USE PLAN Sections: 13.08.01 Plan is accepted 13.08.02 Filed 13.08.01 Plan is accepted The new 2009 Master Land Use Plan, as recommended by the Plamiing Commission, a copy of which is attached hereto, is hereby adopted as the official master land use plan for the city of Van Buren. (Ord.No. 2009-3, Sec. 1.) 13.08.02 Filed The passage, approval,and adoption of this new land use plan is made in accordance with A.C.A. 14-56-422(5), and shall be filed in the office of the City Clerk,who shall also file,with the County Recorder for Crawford County, a copy hereof. (Ord.No. 2009-3, Sec. 2.) CHAPTER 13.12 METROPOLITAN PLANNING ORGANIZATION Sections: 13.12.01 Creation 13.12.02 Authorization 13.12.03 Execution and delivery 13.12.04 Performance 13.12.05 Filed 13.12.01 Creation A. The City Council hereby finds and determines that it is in the best interest of the city to join with the entities named above in the formation of a Metropolitan Planning Organization 0 200 1- S.22 1. For the purpose of banding together the territory under the jurisdiction of the signatory parties the geographical area specified below, 2. To create greater eligibility for grants, loans, and other consideration under federal legislation including,but not limited to 23 U.S.C. 134, et seq., as amended,that can be used for the expenses of planning,research and technical assistance to help the organization determine feasible actions that will improve the existing, as well as the future economic and social environment of the territory under the jurisdiction of the signatory parties, and 3. To provide other services and benefits,for which such functions may in many instance be discharged or performed by a common entity to the mutual advantage of all, including the citizens of the planning area. B. The agreement for the formation of the Metropolitan Planning Organization establishes a planning area to be comprised of the area within the geographical boundaries of the following: Crawford County,Arkansas Sebastian County,Arkansas District 1 of Leflore County, Oklahoma, and District 1 of Sequoyah County, Oklahoma (Ord.No. 2010-23, Sec. 1.) 13.12.02 Authorization The formation of a Metropolitan Planning Organization pursuant to the Acts mentioned above,to be known as the Frontier Metropolitan Planning Organization and the city's participation in the same, are hereby authorized. Upon the dissolution of the existing Bi-State Metropolitan Planning Organization and the formation of the new Metropolitan Planning Organization, all assets, any, and all contractual rights and obligations,as well as any liabilities of the existing Metropolitan Planning Organization shall be transferred to,received by, and assumed by the new Metropolitan Planning Organization. (Ord. No. 2010-23, Sec.2.) 13.12.03 Execution and delivery There is hereby authorized the execution and delivery of an agreement by and between the city and the other governmental subdivisions of the state of Arkansas and Oklahoma mentioned above, and the Mayor and City Clerk are hereby authorized to execute and deliver the agreement for and on behalf of the city. The agreement is hereby approved in substantially the form submitted to this meeting, and the Mayor is hereby authorized to confer with the other parties thereto in order to complete the agreement in substantially the form submitted to this meeting with such changes as shall be proposed by such persons executing the document,their execution to constitute conclusive evidence of such approval. Further, and specifically, if any member entity named herein or in the agreement form attached O 201 5-22 should choose to not be a member of the Metropolitan PlanrLing Organization,then the exclusion of that member entity or entities shall have no effect on the authorization established by this ordinance to enter into the agreement. (Ord.No. 2010-23, Sec. 3.) 13.12.04 Performance The Mayor and City Clerk,for and on behalf of the city, are hereby authorized to execute and directed to do any and all things necessary to effect the execution and delivery of the agreement, and the performance of all acts of whatever nature necessary to effect and carry out the authority conferred by this ordinance. The Mayor and City Clerk are hereby finther authorized and directed,for and on behalf of the city,to execute all papers, documents, certificates and other instruments that may be required for the carrying out of such authority or to evidence the exercise thereof. (Ord.No. 2010-23, Sec. 4.) 13.12.05 Filed The City Clerk is hereby authorized and directed to file in the office of the City Clerk as a part of the minutes of the meeting at which this ordinance is adopted, for inspection by any interested person a copy of this agreement, and such document shall be on file for inspection by any interested person.
