ORD NO 34-1997 l CITY or VAN BUREN, ARKANSAS ()RDiNANCE NO. —1997 AN ORDINANCE AUTHORI ZING THE MAYOR TO EXECUTE A CHANGE ORDER FOR THE 1997 STREET IMPROViMENT PROJECT, PlIASE 11. WHEREAS, The City of Van- Buren desires to continue with a program or street .repairs a17d:itilhI'Oi'L'In:.nfS and as a part of that progr aria advertised and accepted bids for the overlay of portions of Azure Hills, Pointer Trail East (24th ;Street to the Tennis Courts) and Skyline Drive; and, WHEREAS, it has been determined that additional work consisting of r drat7ragc improvements along Skyline Drive, Westwood Drive, and Dark hollow and also the overlay of Sylvan Hills Drive should. be added to the previously approved contract; and. WHEREAS, Because of the previous bidding and acceptance of bid for the overall overiay project in the Skyline. Drive area, use of the formal competitive bidding procedure would not. be feasible and would unnecessarily delay the completion of the required improvements. .NOW, THEREFORE, BEAT ORDAINED BY THE CiTY COUNCIL OF THE CITY OF VAN BUREN, ARKANSAS: SECTION l: 'chat the Mayor is hereby authorized to execute a change order in the 1997 Street Improvement. Project, Phase 11, for the purpose of adding drainage improvements on Skyline Drive and Dark 1lollow, for drainage improvements on Skyline Drive and Westward Drive, and for the overlay of Sylvan Hills Drive. SECTION 2: For the purpose of implementing the change order, the Mayor and City Clerk—Treasurer are hereby autliori'zed to enter into au agreement with the contractor for said improvements at a cost of up to $50500,00 and also to eider into an agreement with Hawkins —Weir Engineers for.an additional $2,400.00 for the additional design services thereon. SECTION 3: That because of the previous advertising and acceptance of kids for the overall overlay project in the Skyline Drive area, and the delay which would be necessitated by the formal competitive procedure, a unique. and exceptional situation exists and bidding by the City of Van Duren is not feasible or practical, therefore., the requirement of competitive bidding is waived. SECTION 4: That the improvements desired being .necessary for the benefit of 1.he driving public and also the residents of the area and this Ordinance being necessary for the preservation of the public peace, health, comfort, convenience, safety, and welfare of the citizens of the City of Van Buren, Arkansas, an emergency is declared to exist and this Ordinance shall be in full force from the date of its approval.
