ORDINANCE NO. 23 -1997
AN ORDINANCE AMENDING VAN BUREN SOLID WASTE MANAGEMENT SYSTEM
AND RECYCLING PROGRAM ORDINANCE NO. 1992 -25, SECTIONS 6 AND 16,
AND REPEALING SECTION 20
WHEREAS, the City of Van Buren, Arkansas, adopted an Ordinance to
Implement a Solid Waste Management System and Recycling Program in 1992
identified as Ordinance No 1992 -25; and,
WHEREAS, the purpose of the Ordinance was to implement a solid waste
management system and recycling program in the City of Van Buren and to protect the
public health and welfare, to prevent the creation of nuisances, to conserve natural
resources and to enhance the beauty and quality of the environment, and that the
reason for establishing said system has not changed; and,
WHEREAS, SECTION 20 deals with dividing the City into service zones and
waiving competitive bidding and that since the initial adoption of Ordinance 1992 -25,
the original residential solid waste collection contracts will expire on December 31,
1997 and the competitive bidding process has been utilized to obtain the services of a
residential solid waste and recycling collection firm for the City of Van Buren and that it
is now necessary to repeal said SECTION; and,
WHEREAS, SECTION' 6 deals with requirements of persons collecting solid
waste generated from their premises and that since the initial adoption of Ordinance
No. 1992 -25, more specific requirements for the same are needed and that it is now
necessary to amend said SECTION; and,
WHEREAS, SECTION 16 deals with the initial (5) year period of Van Buren's
solid waste management system and recycling program and that it is now necessary to
amend said SECTION.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF VAN BUREN, ARKANSAS:
THAT, SECTION 20 of Ordinance No. 1992 -25 be repealed; and,
THAT, Ordinance No. 1992 -25 be amended as follows:
SECTION 6: That each person occupying a residential unit within the City, shall
be required to collect, separate and place upon the premises, in an approved solid
waste container as defined in Section 2(h) of Ordinance 1992 -25, all solid waste
generated thereon, not to exceed (10) ten bags or approved containers per week per
single family residential unit, for mandatory collection by a Residential Solid Waste
Disposal Firm. Commercial waste generated from a residential unit shall not be set out
for collection with the residential solid waste, and that no solid waste container
weighing more than (65) sixty five pounds, including contents of said container, shall be
used for residential solid waste collection.
SECTION 16: That the City shall make, pass and publish such other future
regulations and Ordinances not otherwise authorized and delegated to its agent to
implement as shall be necessary to implement and achieve the purposes and goals of
the City's solid waste management system and recycling program. After this Ordinance
has been in effect for a period of six (6) years, the City may, at its discretion, open the
collection of the City's solid waste management system and recycling program to bids
among all solid waste disposal firms, and may award such collection to the lowest,
responsible bidder.
THAT, any and all parts of Ordinance No. 1992 -25 not heretofore specifically
repealed or amended shall remain in full force and effect from its origination date; and,
THAT, if any Section or part of this Ordinance shall be held to be invalid or
unconstitutional, it shall not effect the remaining Sections thereof, and the Sections and
parts of said Ordinance shall be treated severally; and,
THAT, due to the need to continue to operate and enforce a comprehensive, city
wide, residential solid waste management system and recycling program, an
emergency is declared and exists and this Ordinance being necessary for the
preservation of the public peace, health and safety, shall be in full force and effect from
January 1, 1998,
