REPEALING ORDINANCE NO. 29 -1992 ESTABLISHING MONTHLY
RATES FOR MANDATORY RESIDENTIAL SOLID WASTE COLLECTION
SERVICE FOR THE CITY OF VAN BUREN, ARKANSAS; AND FOR OTHER
PURPOSES
WHEREAS, The City of Van Buren has implemented a mandatory residential
solid waste management system and recycling program pursuant to Ordinance No
1992 -25; and,
WHEREAS, it is the duty of the City Council of the City of Van Buren to approve
rates, charges or contractual fees to be charged by residential solid waste disposal
firms; and,
WHEREAS, the cost of residential solid waste collection within the City of Van
Buren, Arkansas, has increased since the same were established by Ordinance No.
29 -1992, passed and approved November 16, 1992; and,
WHEREAS, the Van Buren Municipal Utilities Commission acting as agent for
the City has recommended a schedule of fees and charges for operation of the
residential solid waste management program.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF VAN BUREN, ARKANSAS, that Ordinance No. 29 -1992 is hereby repealed, and;
SECTION 1: The monthly rate to be charged for each single family residential
unit as defined in Ordinance No. 1992 -25 shall be ($7.50) seven dollars and fifty cents.
The effective date of these charges shall be January 1,1998. These charges shall
cover at a minimum once a week residential solid waste collection (excluding removal
of yard waste materials), twice monthly curbside recycling collection and the operation
of a recycle drop -off center. After this Ordinance has been in effect for three (3) years
and a minimum of every three (3) years afterward the rate schedule established by this
Ordinance may be adjusted based on the accumulated Consumer Price Index as
published annually by the Federal Reserve Bank of St. Louis, provided however, that
this rate adjustment shall not exceed nine percent (9
SECTION 2: The billing and collection for single family residential solid waste
collection shall be performed by the Van Buren Municipal Utilities according to its
customary billing and collection procedures and in accordance with agreement
between the contractors and the Van Buren Municipal Utilities Commission.
SECTION 3: The Municipal Utilities Commission shall deduct the sum of ($1.00)

one dollar and zero cents for each customer for whom a collection was made. The
remainder of charges collected shall be remitted to the collection contractor, in
accordance with the agreement between the Commission and contractor.
SECTION 4: The Municipal Utilities Commission is hereby authorized to
maintain a public assistance program for low income families whose annual income
from all sources does not exceed $15,000.00. The rate to be charged this class of
customers shall be (1/2) one half the total residential rate as defined in Section 1 of this
Ordinance.
SECTION 5: That if any section or part of this Ordinance shall be held invalid or
unconstitutional it shall not effect the remaining Sections thereof; and the Sections and
parts of said Ordinance shall be treated severally.
SECTION 6: That due to the need to maintain and enforce a comprehensive
city wide residential solid waste management system and recycling program, this
ordinance being necessary for the preservation of public peace, health, and safety
shall be in full force and effect from January 1, 1998.
