BE IT ENACTED BY THE CITY COUNCIL, FOR THE CITY OF VAN BUREN,
ARKANSAS,AN ORDINANCE TO BE ENTITLED:
AN ORDINANCE TO AMEND THE VAN BUREN MUNICIPAL CODE,
CHAPTER 11.04 REGULATING BUILDING PERMIT APPLICATIONS
WITHIN THE CITY OF VAN BUREN,ARKANSAS
WHEREAS, A.C.A. 14-56-202 authorizes cities such as Van Buren to issue building permits
for any house or structure; and
WHEREAS, building permits are necessary to assure proper, safe, and sanitary construction in
compliance with State and Local codes and ordinances; and
WHEREAS, the existing Municipal Code Chapter 11.04,Building Permit, includes a building
permit application process and requirements that are no longer relevant; and
WHEREAS, the building permit application process needs to be revised to include information
to ensure compliance with current codes and ordinances.
NOW,THEREFORE,BE IT ORDAINED AND ENACTED BY THE CITY
COUNCIL OF THE CITY OF VAN BUREN,ARKANSAS,THAT:
SECTION 1: Paragraph 11.04.06 of the Van Buren Municipal Code shall be amended to read as
follows:
11.04.06 Application
Building permit applications shall be submitted to the Building Department and shall
contain the following minimum information:
A. Name,mailing address, and telephone number of the applicant.
B. Type building to be constructed or repaired.
C. Location of the building site
D. Outside dimensions of the proposed building or addition
E. Construction materials to be used for the foundation, floor, and exterior walls.
F. Manner in which the proposed building will be anchored to the foundation.
G. Height of the first-floor level above the ground level, as measured from the highest
point of the ground level,
1. Prior to any grading or leveling
2. After grading and leveling
H. Date on which construction is proposed to begin.
I. Approved 911 address for the project.
J. Contractor and subcontractor(plumber, electrical and hvac) information
K. Estimated project cost
L. A property survey
M. A plot plan per Section 11.04.05 of the Van Buren Municipal Code
Note:All easements, setbacks and floodplain information shall be shown on the plot
plan.
N. Construction drawings as required by the currently adopted Arkansas Fire Prevention
Code
O. Plumbing,Electrical and Mechanical plan(Multi-family, Commercial, and Industrial
developments)
P. Driveway Locations and dimensions on the plot plan
Q. Sidewalk location(when required) on the plot plan.
R. Minimum finish floor elevation on the plot plan(if within the 100-year flood plain)
S. Parking arrangement showing individual spaces including all accessible spaces on the
plot plan.
T. Drainage plan and retention when required(Multi-family, Commercial, and Industrial
developments)Note: a drainage plan may be required for a single family or duplex
when the property is in a flood plain or other significant drainage area.
SECTION 2: Delete paragraph 11.04.08 of the Van Buren Municipal Code in its entirety.
SECTION 3: The provisions of this ordinance are hereby declared to be severable and if any
section,phrase,provision, or application shall be declared or held invalid, such
invalidity shall not affect the remainder of the sections,phrases,provisions, or
applications.
IN WITNESS WHEREOF,the City of Van Buren,Arkansas,by its City Council, did
pass, approve, and adopt,by a vote of for and against the foregoing Ordinance at its
regular meeting held on the 181h day of December 2023.

SUBJECT: VAN BUREN MUNICIPAL CODE AMENDMENTS—MINIMUM
INFORMATION FOR BUIDLING PERMIT APPLICATIONS

The Van Buren Municipal Code includes sections with minimum requirements for building
permit applications. These sections need to be amended because they do not reflect current
practice do not include all the necessary minimum requirements that are necessary for the review
of a building permit application.
In addition to the lack of minimum information missing from the existing ordinance but the
current City code requires all building permits to be submitted to the Mayor and that the Mayor
will present each permit application to the City Council at its next regular meeting.
I have enclosed a copy of the Municipal Code sections 11.04.06 and 11.0-4.08. The Highlighted
sections represent new language, and the Strike-through language represents all that is proposed
to be deleted.
With this list it should remove any confusion and inconsistency regarding the minimum
requirements for a building permit application and with the adequate information will help the
City staff better determine if the project meets the minim-Lim requirements of the City's codes
and ordinances.
A public hearing was held by the Planning Commission at their November 7,2023,meeting.
After discussion,the Planning Commission voted unanimously to recommend the amendment to
the City Council.
