NOTICE OF CONSENT
This is a notice of consent by AOG to the proposedp use of the ROW described below
("Notice") is made and entered into this V7 day of Ct_ tort 20o?3by and between
Frankie & Alice Deramo with its principal address at 734
South 40'h St, Van Buren, AR 72956 (the "Landowner") and Arkansas Oklahoma Gas
Corporation ("AOG") with its principal address at 10825 E. Geddes Ave, Suite 410, Centennial

The Landowner desires to lay gravel and utilize AOG's ROW for ingress and egress to
their property within or partially within, AOG's ROW ("Use");

provided that the Landowner agrees to maintain the proper
clearances
and uninterrupted access to
AOG's gas lines; as described
below:
1. This Notice
does not amend,
modify or alter the
AOG ROW; it is
intended only as a
clarification
that the proposed
Use by Landowner is
permissible under
the ROW.
2. The general locations of [he AOG ROW aze shown on the attached exhibit.
3. Both parties are committed to cooperating with each other during use of their respective
interests in the property;
4. Tn the event that it is reasonably necessazy for AOG to access its .facilities and the Use
interferes with such access, AOG is entitled to modify or remove Landowner's
improvements that encroach on AOG's ROW to the extent necessary to access AOG's
facilities. AOG may seek reimbursement from Landowner for the actual costs of modifying
or removing such improvements. Landowner shall not seek and cannot recover any
damages for its modified or removed improvements.
5. AOG does not grant, sell, or convey to Landowner any rights or interests in its right-of-
way through this Notice;
6. All Landowner crossings must have a clearance of to from AOG's facilities. Landowner
may not construct any permanent improvements or facilities (including paving) that
interfere with AOG's ability to access its facilities or use of AOG's ROW,
7. AOG does not assume any liability or responsibility for the Landowner's Use.
