Reynolds City Clerk-Treasurer %y kill f f�M .� .rx i CITY OF VAN BUREN,ARKANSAS ORDINANCE NO.OR-2023 BE IT ENACTED BY THE CITY COUNCIL,FOR THE CITY OF VAN BUREN, ARKANSAS,AN ORDINANCE TO BE ENTITLED: AN ORDINANCE ANNEXING TERRITORY ADJACENT AND CONTIGUOUS TO THE CITY LIMITS OF THE CITY OF VAN BUREN, ARKANSAS, LYING IN CRAWFORD COUNTY, ARKANSAS,PETITIONED FOR ANNEXATION TO THE CITY OF VAN BUREN BY ORDER OF THE COUNTY COURT OF CRAWFORD COUNTY ON THE 11TH DAY OF SEPTEMBER 2023, AND ZONING SAID TERRITORY C-2 (THOROUGHFARE COMMERCIAL DISTRICT) WHEREAS, a petition was filed pursuant to A.C.A. 14-40-609, with the County Clerk of Crawford County,Arkansas, by the Crawford County Conservation League, Inc., owner of the hereinafter described territory, praying that said territory be annexed to, and made part of the City of Van Buren,Arkansas; and WHEREAS, on September 11, 2023, the County Court of Crawford County,.Arkansas, found that the petition was signed by the Crawford County Conservation League, Inc., owners of said territory; that said territory is contiguous and adjoining the present corporate limits of the City of Van Buren,Arkansas;that an accurate description of said territory had been filed with and made part of said petition; that proper notice had been given for the time and in the manner prescribed by law,and that said lands and territory should be annexed to and made part of the City of Van Buren, Arkansas, subject to the acceptance of the same by the City Council of said City at the proper time, as provided by law; and WHEREAS, the County Court of Crawford County, Arkansas, has issued county court orders 2023-36 and 2023-37 referring the Petitions for Annexation to the City of Van Buren,Arkansas; and WHEREAS, notice of a Public Hearing was duly published in the Times Record on September 17th and a public hearing was conducted by the Planning Commission on October 3, 2023; and WHEREAS, as a result of this hearing,the Planning Commission has recommended that certain property be annexed into the city limits and zoned C-2 (Thoroughfare Commercial District); and NOW THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF VAN BUREN,ARKANSAS,THAT: SECTION 1: The Crawford County Conservation League is the owner of the following described land lying adjacent to and contiguous to the present city limits of the City of Van Buren,Arkansas. SECTION 2: The schedule of services to be provided for the property shall include fire department services, police department services, and all rights and privileges that are had and enjoyed by the inhabitants within the limits of the City of Van Buren. SECTION 3: The following described land and territory contiguous and adjoining the City of Van Buren,Arkansas, shall be accepted,as part of and annexed to,and made a part of the City of Van Buren: LEGAL DESCRIPTION Lots 1 and 2A of Lake Louemma Addition SECTION 4: The map showing said described land is approved and confirmed, and a copy thereof is attached hereto. SECTION 5: Said land is hereby annexed into the City of Van Buren,Arkansas and made part of Ward 1 of the City of Van Buren. SECTION 6: The zoning map is amended to classify the annexed land as C-2 (Thoroughfare Commercial District). SECTION 7: Thirty (30) days after passage and publication of this Ordinance, the annexation shall be final and the property shall be within the corporate limits of the City of Van Buren, except as otherwise ordered by the Circuit Court pursuant to a cause of action filed within said thirty (30) day period. SECTION 8: Within forty-five(45)days of the effective date of this ordinance the city clerk shall provide written notice of the annexation,along with complete documentation to the Crawford County Clerk. A copy of their petition and the Order granting annexation is attached for your review. The City staff and departments have reviewed the annexation petition.During the review of the petition by city staff there is a concern about the Schedule of Services (Exhibit C)in the petition. The petition says that within three(3)years, Trash services and Water and Sewer utilities will be extended to the subject property. The response to two items in the proposed schedule of services is as follows: C. Trash Services: The City of Van Buren or the City of Van Buren Municipal Utilities does not provide Trash Services nor regulate which private companies are hired/contracted by a commercial facility to remove trash. City Ordinance requires commercial facilities to hire their own trash collection hauler and have trash removed from facility. The City of Van Buren does not regulate or contract with private sanitation haulers for facilities other than single family residential collection. d. Water and Sewer Utilities: The property is currently within the City of Van Buren Public Water&Sewer System Service Area, the City of Van Buren or the City of Van Buren Municipal Utilities does not extend City of Van Buren Public Water&Sewer System Lines into areas at the expense of existing ratepayers. The cost of the extension of these services is the responsibility of the property owner/developer. The Crawford County Conservation League Board has submitted a written and signed statement indicating they understand that they do not expect these services to be provided by the City. A copy of that written and signed statement is enclosed. A question was asked at the Planning Commission about the City's authority to annex the subject property based on a previous discussion about annexing Lake Louemma. Mr. Jared Medlock, the attorney for the annexation, answered that they were satisfied there was nothing that would prevent the annexation of the property. The Planning Commission voted to recommend approval of the annexation and suggested the Council should assure themselves that they have the authority to annex the property. The Planning Commission also voted to recommend the zoning map be amended to apply C-2 zoning to this property. The Ordinance includes: • sections to annex the property,place the property in Ward 1 and amend the zoning map to a C-2 zoning classification. • a section acknowledging A.C.A. [14-40-609 (f)(1)] that the annexation will be final thirty(30) days after passage of the Ordinance pending any cause of action which may be filed in the circuit court by a person asserting and having an ownership right in the property objecting to the petition objection or by any person asserting a failure to comply with this section. [A.C.A. 14-40-609 (g)] • a section giving direction to the City Cleric to provide written notice along with complete documentation to the county clerk withing forty-five(45) days of the effective day of the ordinance as required by A.C.A. 14-40-102 (b)(1).
