EASEMENT ` o KNOW ALL MEN BY THESE PRESENTS: THAT, 'TOM WELLNITZ and BETTY JO WELLNITZ, GRANTORS, forty and in consideration of the sum of One Dollar ($1.00) an otrh.er'` H� good and valuable considerations, receipt of which is hereby acknowledged, do hereby grant, bargain, sell and convey to the CITY OF VAN BUREN, ARKANSAS, GRANTEE, its successors and assigns, a permanent easement and right®of-way for the construction and maintenance of a roadway with all appurtenances thereto, together with the right to remove trees, brushes, undergrowth or other obstructions interferring with operation and maintenance of said roadway over, under and upon the following lands in the County of Crawford, State of Arkansas, to -wit: A fifteen (151) foot wide sanitary sewer easement being part of the Southeast Quarter, Southwest Quarter, Section 10, Township 9 North, Range 32 West, Crawford County, Arkansas, said easement being 7.5' either side of the center line described as follows: Commencing at the Northeast corner of said Southeast Quarter, Southwest Quarter; thence South 350,01; thence West 483.4 feet to the Southwest corner of the Van Buren Sewage Treatment Plant Site; thence North 7.5' to the point of beginning; thence West parallel to the North line of said Southeast Quarter, Southwest Quarter, 790.0' more or less to the point of termination at the East bank of Lee's Creek, with rights of ingress and egress over the same. TO HAVE AND TO HOLD the same to the said GRANTEE, its successors and assigns forever. The said GRANTORS, their heirs and assigns to fully use and - enjoy said premises, provided that they shall not interfere with the use thereof by GRANTEE and further GRANTOR will not erect a permanent building or other structure within the width of said easement. That the Easement granted herein shall be a private Easement to the Citv of Van Buren, its employees and all authorized persons for the purpose of building, operating and maintaining the sanitary MI�Q RE � a 9 sewage treatment plant located near this site. The GRANTEE herein shall have the right and the authority to build and maintain the roadway and associated drainage facilities. The GRANTEE herein shall have the right to limit access over the described roadway to the treatment plant site to only authorized persons. IF The consideration paid by the GRANTEE is received and accented by the GRANTORS in full satisfaction of every right hereby conveyed. The disturbed area shall be returned to a condition equal to the pre -construction condition of the property.
